Sears returns, order cancellation, repairs, protection plans and disputes: what Sears's own pages say (checked October 6, 2026)
This section was checked on October 6, 2026 against pages that Sears publishes today. Posts on this site about Sears are mostly dated 2008 to 2013, when a different company operated the business, so older posts may describe rules that no longer apply. Start by working out which Sears you dealt with, because the rules differ.
- Bought in a Sears store or on sears.com as 'Sold by Sears': the Sears return policy and the Terms of Use below apply.
- Bought from a Marketplace seller on sears.com: the seller's own policy applies. The return page says: "Sears Marketplace items are sold by third-party businesses (called 'Marketplace Sellers') who sell items via our websites and shopping apps. Seller returns policies may vary."
- Shipped by Kmart: the return page says "Any products that are shipped from Kmart can only be returned by shipping or to a Kmart store."
- A repair visit or a Sears protection agreement: see the Sears Home Services and protection-plan paragraphs below.
- A Sears-branded credit card: Sears's About Us page says payments are accepted by "Shop Your Way Mastercard, Sears MasterCard (now Citi ThankYou MasterCard), Visa, MasterCard and Discover". Card billing disputes go to the card issuer named on the statement.
Returns and cancellations. Sears's 'How to Return or Cancel an Order' page says: "Shop Your Way Members now get 45 days from date of purchase to return most items! 30 days for all delivered/installed products from date of delivery/installation and 30 days from date of purchase for most products for non-members." It adds: "Applicable shipping charges will be deducted from your refund unless the return is a result of our error." It also says "Sears items cannot be returned to Sears Outlet or Sears Hometown stores." The Sears Return Policy page ("Effective with sales starting February 7, 2018") says refunds "Will be issued in the same form as the original method of payment", that for delivered items you "must report any damage (visual or functional), within 3 days of delivery to be eligible for a return", and that "Delivery, labor &/or installation fees will not be refunded". It lists a 15% restocking fee for mattresses, foundations, assembled or upholstered indoor furniture, water heaters, built-in home appliances and some other items, "not applicable where prohibited by law, item is defective, or incorrect product was delivered". For mattresses it says you "must use the mattress set for 30 nights before requesting a return or exchange" and then may request a one-time comfort return.
Cancelling an order. The Terms of Use (effective June 1, 2025) say: "Orders you submit online may be cancelled until they are processed. Orders with a status of 'Processing' may not be cancelled, and you must wait until your receive the merchandise in order to return it." The page also lists an order-status link and a 'Cancel an Order' item on the Customer Service page.
Price match and price protection. The Price Match Policy page ("Effective August 22, 2019") says: "If an item you have purchased from Sears goes on sale for a lower price within 30 days of your purchase, Sears will refund the difference." It excludes, among other things, Marketplace items and items sold by Sears Outlet, and lists further exclusions.
Repairs (Sears Home Services). The searshomeservices.com FAQ says the service charges a diagnostic fee that "typically ranges from $90 to $150 for most areas and is only charged on the day of service", that after the technician gives an estimate "If you proceed with the recommended repair, the diagnostic fee will be waived", and that call-center agents are available Monday to Friday 6:00 AM to 10:30 PM CST and on weekends 7:00 AM to 9:00 PM CST. It gives 1-800-4-MY-HOME as the customer-service number; the site header also shows 802-552-4364. The site's own terms (effective July 1, 2025) are a separate page from the sears.com Terms (effective June 1, 2025).
Protection agreements and home warranty. Plans sold before the 2019 sale were taken over by the buyer: the sale order says the buyer "expressly assumed Sellers' obligations ... with respect to warranties and protection agreements or other services contracts ... for the goods and services of Sellers sold or performed prior to the Closing". The current Sears Protect home warranty site says: "Coverage does not begin until 30 days after you purchase the plan" and names the seller of plans as Transform Sears Home Services LLC in most states (Transform Insurance Agency Inc. in Texas, and different sellers and issuers in California); the full terms are in its sample terms and conditions, which this page does not summarize. For older plans, Sears's Protection Agreements page says: "For information regarding your plan, including your Benefit Summary, Terms & Conditions, and to submit a claim, please visit https://agreement.searshomeservices.com" (Master Protection Agreements and Sears Repair Agreements), and that Sears Purchase Protect "is no longer sold"; its claims site is www.searspurchaseprotect.com.
Where to start a return, cancellation or gift-card check. The Sears Customer Service page (read October 6, 2026) lists under Order Management: "Check Order Status", "Cancel an Order" and "Make a Return/Exchange", and under Payment & Billing: "Gift Cards". The sears.com gift-card page says: "Good at Sears and Kmart, online and in store. No fees. No expiration." and links to "Check balance & reload".
Protection-agreement terms (April 2024 version). The Sears Protection Agreement terms and conditions for purchases in the United States (dated April 2024) name Transform Sears Home Services LLC, 5407 Trillium Blvd, Suite B120, Hoffman Estates, IL, as "Administrator", and define the "Obligor" as Federal Warranty Service Corporation (all states except Florida and Oklahoma), United Service Protection, Inc. (Florida) or Assurant Service Protection, Inc. (Oklahoma). On cancellation they say: "You may cancel this Agreement at any time for any reason by calling 1-800-4MY-HOME® or by mailing written notice of cancellation" to Cancellation Services (Spokane Valley, WA). Their insurance clause says that if the Obligor fails to meet its obligations, you may, "sixty (60) days after filing your request for service or payment", submit your claim to American Bankers Insurance Company of Florida, 1-800-852-2244. The plan you hold may be a different version; check the agreement you received.
Written dispute notice. The Terms of Use say that before starting a court action a customer agrees to "provide, in writing to the address listed below, notice of your claim" and to allow "no fewer than sixty (60) days" to resolve it. The address is Transform SR Holding Management LLC, 5407 Trillium Boulevard, Suite B120, Hoffman Estates, IL 60192, Attention: Legal Intake. The Terms add a class-action waiver that applies if the claim exceeds $1,000, a one-year time limit for claims "except where prohibited by law", and Illinois governing law. They also cross-refer to a 'Confidential Arbitration' section; the page text read on October 6, 2026 contains no section by that name.
Other routes. Sears's Help & Contact Us knowledge base (knowledge.sears.com) lists articles such as 'How do I contact Sears?', 'How do I cancel an order?' and warranty-claim articles; the article texts could not be opened for this page. Outside the company: the BBB profile (complaints can be submitted through BBB), the Illinois Attorney General (its consumer page says the office takes complaints about purchases and home repair and construction services), the CFPB for a Sears-branded credit card ((855) 411-2372, 'Submit a complaint about a financial product or service'), and ReportFraud.ftc.gov. The consumer-protection office of your own state attorney general is another route.
Government actions: 1997 state judgments, 2009 FTC order, 2016 EPA lead-paint settlement, CPSC recalls, 2021 security notice
Home-improvement lead-paint settlement, 2016. A Justice Department and EPA announcement dated September 28, 2016 describes a settlement with Sears Home Improvement Products Inc. resolving alleged violations of the federal Lead Renovation, Repair and Painting (RRP) Rule for work done by Sears's contractors; Sears was to adopt a company-wide program for certified contractors and "will also pay a $400,000 civil penalty". The release says the consent decree was lodged in the U.S. District Court for the Northern District of Illinois subject to a 30-day public comment period; whether it was later entered was not confirmed in the sources checked. The release describes Sears Home Improvement Products as part of the Sears Home Services division of Sears Holdings Corporation and the matter as alleged violations.
1997 multistate judgments. The California Attorney General's page on the Sears Fund says: "In 1997, Sears, Roebuck and Company entered into judgments with the Attorneys General of all 50 states to resolve complaints concerning Sears's unlawful consumer bankruptcy and debt-collection practices." The settlement established a $5 million fund for consumer-protection grants; the Massachusetts Attorney General's office is its custodian.
FTC, 2009: tracking-software order. On June 4, 2009 the FTC announced that Sears Holdings Management Corporation, "owned by Sears, Roebuck and Company and Kmart Management Corporation", had agreed to settle charges that it failed to disclose adequately the scope of consumers' personal information collected by a downloadable "My SHC Community" research application offered to sears.com and kmart.com visitors for $10. The FTC's complaint alleged the software also monitored secure sessions on third-party sites and collected information such as online bank statements and prescription records, and that the full extent was disclosed only in a lengthy license agreement. The settlement agreement states it "is for settlement purposes only and does not constitute an admission by proposed respondent that the law has been violated as alleged". The final consent order was issued August 31, 2009 (FTC File No. 082-3099, Commission vote 4-0, announced September 9, 2009): it required destroying previously collected data and clear, prominent disclosure before any covered tracking software is installed, and it terminates on August 31, 2029 unless a later complaint extends it. On February 28, 2018 the FTC approved, by a 2-0 vote, a petition by Sears Holdings Management Corporation to reopen and modify the order's definition of "Tracking Application"; mobile applications remain covered.
CPSC recalls in which a Sears company is listed as importer or distributor. These recalls concern products made by other firms and are historical; the CPSC record, not this summary, is the authority on models and remedies. Kenmore dehumidifiers made by LG: recalled August 2, 2012 (about 795,000 units; CPSC: "The firm has received 107 reports of incidents, with more than $7 million in property damage and three reports of smoke inhalation injuries") and re-announced July 17, 2013 because of a low response rate and additional incident reports; CPSC's remedy text offered a Sears gift card of $75, $80, $90 or $100, or a check, plus a $25 coupon. Kenmore oscillating fan heaters: recalled January 15, 2014 (about 42,500 units; broken motor mounts can cause overheating; refund). Kenmore Elite microwave oven model 204.77603610: CPSC record dated November 14, 2019 (about 700 units; incorrect wiring can make the exterior exceed 183 degrees Fahrenheit; no injuries reported; free in-home repair). Sears's own recall page says it lists "items subject to recall that have been sold by Sears, Sears Grand or Sears Essentials"; many entries are other manufacturers' recalls. Consumers can also report product incidents at SaferProducts.gov, and a customer whose recalled product is not remedied can contact the CPSC.
Data-security notice, 2021. A Transformco press release of July 26, 2021 says Transform SR Holding Management LLC "determined that the unauthorized access occurred between June 3, 2021 and June 15, 2021" and that the systems accessed "may have contained Social Security numbers, financial account numbers, and/or healthcare insurance information about current and former Transformco employees"; the release is directed at employees.
Scope of this section. The sources opened for this page on October 6, 2026 were the FTC case page for File No. 082-3099, the CPSC recall database, Justice Department and California Attorney General pages, and court dockets. State attorney-general, state appliance-repair and state insurance-regulator enforcement databases were not searched, so this is not a complete list of government actions.
Who operates Sears, the 2019 sale from Sears Holdings to Transform Holdco, and the Sears name today
Who operates Sears today. The sears.com Terms of Use (effective June 1, 2025) say the website is "owned and operated by Transform SR Holding Management LLC, on behalf of itself and for its subsidiaries and affiliates (collectively, 'Transformco', 'Sears')", and the site footer reads "2026 Transform SR Brands LLC. All Rights Reserved". A Transformco press release describes Transform SR Holding Management LLC as "a subsidiary of Transform Holdco LLC". The sears.com footer links to Transformco's corporate site, and its cookie notice refers to "other Transformco websites". The BBB profile for 'Transformco' (Hoffman Estates, IL) shows new ownership on 2019-02-11.
How the brand changed hands. Sears, Roebuck and Co. and Sears Holdings Corporation, with dozens of affiliates, filed for Chapter 11 on October 15, 2018 (Case No. 18-23538, U.S. Bankruptcy Court, S.D.N.Y.). On February 8, 2019 the court entered an order approving an Asset Purchase Agreement dated January 17, 2019 under which Transform Holdco LLC (the 'Buyer') acquired certain of the debtors' assets. The order records that the buyer "expressly assumed" the sellers' warranty and protection-agreement obligations for goods and services sold or performed before closing. It was an asset sale: the debtor companies were not themselves acquired. On October 15, 2019 the court confirmed a liquidating plan (see the litigation section). Posts on this site that name Sears Holdings, Sears Roebuck or Sears Home Improvement from before 2019 therefore concern the earlier operator.
What Sears says about itself. The Sears About Us page tells a company history beginning in 1886 and says Sears "opens its first retail store in Chicago's Westside" in 1925. It says DieHard "was owned by Sears, but was later acquired by Advance Auto Parts" and that Craftsman "is now owned by Stanley Black & Decker", and the footer links a Kenmore site. These are the company's statements; the page's marketing claims (for example about tool sales) are not independently verified here.
Parts of the Sears name. Sears Home Services (repair and home improvement), Sears PartsDirect and the Sears Protect home warranty are linked from the sears.com and searshomeservices.com footers. Sears Puerto Rico is a separate site (searspr.com) linked as an external link, and this page does not cover it or Sears Canada; posts naming Sears Canada are not counted below. Court record: the master protection agreement class action and the Sears Holdings Chapter 11 case and 2019 sale
Greene v. Sears Protection Company, No. 1:15-cv-02546 (N.D. Ill.). A putative class action filed March 25, 2015 by Gerald and Nina Greene against Sears Protection Company, Sears, Roebuck and Co. and Sears Holdings Corporation over aftermarket master protection agreements (MPAs). The docket shows a memorandum opinion of June 25, 2018 (Doc. 200) ruling on the class-certification objections and, on August 29, 2018, an order amending the Pennsylvania consumer-protection class definition to: "All residents of Pennsylvania who paid for aftermarket MPAs on March 25, 2009 to the present ... for products which were not covered by nor eligible for coverage under the MPA, and did not receive a full refund." The Seventh Circuit denied the defendants' Rule 23(f) petition on August 21, 2018. After the defendants gave notice of their bankruptcy filing, the court stayed the case on October 18, 2018 and placed it on its inactive docket. The last entry on the docket page opened October 6, 2026 is dated May 21, 2019. The defendants opposed class certification, and nothing in the docket page decides the merits; the allegations are unproven.
In re Sears Holdings Corporation, Case No. 18-23538 (Bankr. S.D.N.Y.). The lead Chapter 11 case was filed October 15, 2018. The February 8, 2019 order (Doc. 2507, signed by Judge Robert D. Drain) approved the sale of certain assets to Transform Holdco LLC and, in paragraph 18, the buyer's assumption of the sellers' warranty and protection-agreement obligations. The Order Confirming the Modified Second Amended Joint Chapter 11 Plan (Doc. 5370) is dated October 15, 2019 and provides for a Liquidating Trust. The docket was still active on October 5, 2026: entries in 2026 include post-confirmation quarterly operating reports filed by the SRZ Liquidating Trust (for example July 23, 2026) and stipulations granting limited relief from the plan injunction to individual claimants (for example August 20, 2026, Doc. 11049). This page does not describe the claims of any individual party.
Other court records. A CourtListener caption search for 'Transform SR' run on October 6, 2026 returned 34 dockets, among them disability-access, employment, trademark and product-liability matters, plus a 2025 Telephone Consumer Protection Act-type docket listed against SR Holdings Management LLC. They include a class-action waiver for claims over $1,000, a one-year limit on claims except where prohibited by law, and Illinois governing law.
