Capital One disputes, credit bureau corrections, complaints and settlements: what Capital One's own pages say (checked October 6, 2026)

Capital One's own pages, opened on October 6, 2026, set out the routes below. Most posts about Capital One in this site's archive are dated 2002 to 2013 (plus two from 2025), so they describe practices of those years rather than today's terms.

Phone numbers published by Capital One. The Contact Us page lists 1-800-CAPITAL (227-4825) “for servicing of existing Capital One accounts” and 1-877-383-4802 (“Not sure where to start? Call us ... so we can direct your call to the right person”). Its Feedback & complaints page says: “Call Capital One customer support at 1-844-348-8660. (Includes “Discover, by Capital One” Card Accts)” and “Call Discover customer support at 1-800-DISCOVER (1-800-347-2683).” The Contact Us page adds that for Discover accounts you should continue using the number on the back of your card. These are the numbers the company publishes today; older numbers quoted in archive posts may no longer work.

Disputing a card charge. Capital One's Help Center separates a dispute (you authorized a charge but there is a problem with the merchant, product or service) from a fraud claim (a charge you or no one on your account made). It says to contact the merchant first because “it can take up to 90 days for Capital One to resolve a dispute”; to dispute “ideally within 60 days of the statement date” (it says it “may be able to assist with your claim even if this 60-day window has passed”); and that a pending transaction “can't be disputed” until it posts. A dispute can be filed in the app or on the website, by calling the number on the back of the card, or by mail to Capital One Disputes, P.O. Box 30279, Salt Lake City, UT 84130-0279. Capital One says it “may provide a temporary credit” while the case is open, that outcomes “are based on rules set by the credit card network (Visa, Mastercard or Discover)”, and that the final message will explain how to appeal.

Disputing information Capital One reports to the credit bureaus. The Help Center says Capital One is “required by the Fair Credit Reporting Act to conduct reasonable investigations on credit bureau disputes” and that accurate late-payment information cannot be removed on request. It lists separate mailing addresses: credit cards, P.O. Box 31293, Salt Lake City, UT 84131-1293; auto loans, Credit Bureau Dispute, P.O. Box 259407, Plano, TX 75025-9407; and, for personal loans and deposit accounts, Capital One Consumer Services, PO Box 30273, Salt Lake City, UT 84130-0273 (Equifax, TransUnion or Experian reporting) or Capital One Bank, Attn: Loss Mitigation Dept, PO Box 85026, Richmond, VA 23285 (ChexSystems and Early Warning Systems reporting). The page says Capital One will “respond within 30 days of receiving the dispute.” Disputes can also be filed with Equifax, Experian or TransUnion directly.

Disputing a debit card charge. For deposit accounts, the Help Center says to call 1-866-536-9023 (8am to 11pm ET, 7 days a week), “strongly encourage[s]” filing within 60 days after the statement, says a temporary credit may be provided within 10 business days if the claim is eligible, and says an investigation “can usually take between 90 to 120 days.”

Complaints about auto loans. The Capital One Auto Finance feedback form asks what the complaint relates to (Payments, Titles, Dealer, Credit Report or Other) and says “an agent will reach out using the contact information you provided.” Capital One Auto Finance is a different business from a dealer that arranged the loan.

Outside complaint routes. The CFPB accepts complaints about financial products at consumerfinance.gov/complaint and says “Most companies respond within 15 days.” Capital One, National Association is a national bank, and the OCC says customers of national banks can use HelpWithMyBank.gov or the OCC's Customer Assistance Group to get answers or file a complaint about a bank. State attorney general offices also take consumer complaints. Complaints sent to a regulator are the consumer's account; the regulator does not decide the dispute for you. HelpWithMyBank.gov says the OCC cannot give legal advice, “Act as a court of law or as an attorney on your behalf,” “Advocate for either party” or “Seek monetary compensation”; its Customer Assistance line is 1-800-613-6743.

Class settlements. Two large settlements are described under “Capital One consumer lawsuits and settlements” below: the 2019 data breach settlement (the claim period is closed; the settlement site says Identity Defense and restoration services run through February 13, 2028) and the 360 Savings settlement (final approval granted April 20, 2026, with an appeal pending). A proposed Canadian data breach settlement and a credit reporting settlement (Kromrey) are described in the lawsuits section.

Capital One CFPB, OCC and attorney-general actions

The actions below are listed from the primary documents opened on October 6, 2026. Orders in which a company “neither admits nor denies” the findings are not admissions, and allegations in a lawsuit are not findings.

CFPB consent order, credit card add-on products (July 2012; terminated 2016). The CFPB's Consent Order (File No. 2012-CFPB-0001) concerned Capital One Bank (USA), N.A.'s marketing of Payment Protection and Credit Monitoring products to credit card holders between August 1, 2010 and January 9, 2012. The order says: “The CFPB finds, and the Bank neither admits nor denies,” a violation of Sections 1031 and 1036 of the Consumer Financial Protection Act, and that the Bank consented “without admitting or denying the findings of fact or conclusions of law.” The CFPB's termination order, filed September 20, 2016, says the Bank had fulfilled the order, “including ... providing at least $140 million in redress to approximately 2 million affected consumers,” paid “a civil money penalty of $25 million,” and ceased marketing the add-on products. Several older posts in this site's archive mention payment protection or credit monitoring charges.

OCC civil money penalty, August 6, 2020. The OCC assessed an $80 million civil money penalty against Capital One, N.A. and Capital One Bank (USA), N.A. Its release says the action was “based on the bank's failure to establish effective risk assessment processes prior to migrating significant information technology operations to the public cloud environment and the bank's failure to correct the deficiencies in a timely manner,” that the OCC “positively considered the bank's customer notification and remediation efforts,” and that the penalty is paid to the U.S. Treasury. The Consent Order (EA 2020-036) states: “The Comptroller finds, and the Bank neither admits nor denies” the findings. The OCC's release also links a Cease and Desist Order (EA 2020-037). Whether either order has since been terminated was not confirmed in the sources checked on October 6, 2026.

CFPB lawsuit, January 14, 2025 (dismissed February 27, 2025). The CFPB's enforcement page says the Bureau sued Capital One, N.A. and Capital One Financial Corp. alleging violations of the Consumer Financial Protection Act's prohibition on deceptive and abusive acts and practices, and, as to Capital One, N.A., the Truth in Savings Act and Regulation DD. It also says: “On February 27, 2025, the Bureau filed a notice voluntarily dismissing the action against all defendants with prejudice, and the court ordered the case to be closed the same day.” The page does not describe the product in its summary.

New York Attorney General lawsuit, May 14, 2025. Capital One's Form 10-Q for June 30, 2026 says the New York Attorney General sued Capital One in the Southern District of New York “alleging a variety of causes of action under New York and federal law based on factual allegations similar to those raised in the Savings Account Litigation,” that the case was transferred to the Eastern District of Virginia on August 7, 2025, and that the December 2025 class settlement “also resolves the New York Attorney General Litigation.” See the lawsuits section for the settlement.

Orders inherited from Discover. The 2025 Form 10-K says Discover, which merged into Capital One on May 18, 2025, was a party to enforcement actions and that Capital One and Capital One, N.A. now have going-forward obligations: a December 2020 CFPB consent order about private student loan servicing practices (which “by its terms remains in effect until December 2030 for issues that occurred prior to the sale and transfer of servicing”), and an April 18, 2025 Federal Reserve consent order about the Discover “Card Product Misclassification,” which required a civil money penalty paid before closing and which Capital One “committed to satisfy.” The 10-Q says Discover reserved $1.2 billion for that matter, that a merchant class settlement received final approval on May 20, 2026, that a shareholder class action is pending after an amended complaint, and that the company is cooperating with an SEC investigation. These concern Discover's card pricing tiers for merchants, not Capital One card accounts.

About Capital One Financial Corporation: Capital One, Discover and Brex

Who operates Capital One. The registrant is Capital One Financial Corporation, a Delaware corporation “established in 1994” and headquartered at 1680 Capital One Drive, McLean, Virginia (2025 Form 10-K, filed February 19, 2026). The filing says its principal operating subsidiary at December 31, 2025 was Capital One, National Association (“the Bank”), and that the company was “the largest issuer of credit cards in the United States” by outstanding card loan balances at that date (company statement). The same filing says the company offers debit cards, bank lending, treasury management and deposit services, auto loans and other consumer lending, through digital channels, branches, cafes, call centers and ATMs, plus card services in the U.K. (Capital One (Europe) plc) and a Canadian branch. Its common stock is listed on the NYSE.

Discover and Brex. The 10-K says that on May 18, 2025 Discover Financial Services merged into Capital One and Discover Bank merged into Capital One, N.A. Discover cards, personal loans and the Discover, PULSE and Diners Club networks are now part of the company. Capital One's Contact Us page notes that “content on this page may not apply to some Discover products” and tells Discover cardholders to use the number on the back of the card. The June 30, 2026 10-Q says Capital One completed its acquisition of Brex Inc., a business card and expense-management provider, on April 7, 2026.

Names you may see. Older regulator documents and archive posts use “Capital One Bank (USA), N.A.”, “Capital One Auto Finance” and “Capital One Services”. Capital One Auto Finance is the name on Capital One's auto loan complaint form. This page did not verify the current corporate status of Capital One Bank (USA), N.A.

Capital One consumer lawsuits and settlements

The cases below come from court documents and Capital One's SEC filings opened on October 6, 2026. Allegations are not findings, and a class settlement is not a court finding that a claim was true.

2019 data breach class action (settled). Capital One announced on July 29, 2019 that an outside individual gained unauthorized access to its systems in March 2019 and obtained certain personal information about people who had applied for Capital One credit card products and card customers (2025 Form 10-K). The consolidated federal case (E.D. Va., MDL No. 1:19-md-2915) ended in a class settlement with a $190 million settlement fund for a class the court described as approximately 98 million people; the court's Order and Judgment Granting Final Approval is dated September 13, 2022. The settlement website says the claim filing period is closed and that the Identity Defense Services (members who did not claim by September 30, 2022 may still enroll while the service is active, until February 13, 2028, after phoning for an enrollment code) and free Restoration Services (for all class members, even those who never made a claim) are available through February 13, 2028. In Canada, the 10-K says four putative class actions over the same incident remain, with classes certified in British Columbia and Quebec; a separate settlement site for the British Columbia action is described below.

360 Savings class action and New York Attorney General case. The 10-Q for June 30, 2026 says savings account holders sued in the Eastern District of Virginia on July 10, 2023 over the introduction of a savings product with a higher interest rate than existing savings accounts, and that the related cases were consolidated there. It says the court denied final approval of a first settlement in November 2025; that the parties reached a new settlement in December 2025 with a $425 million fund and an agreement to raise the interest rate on 360 Savings accounts to match 360 Performance Savings; and that the court granted final approval on April 20, 2026. A docket entry for an individual objector's notice of appeal shows an appeal to the Fourth Circuit filed in June 2026 (No. 26-1807). Because of that appeal, this page lists the case as pending rather than concluded. The official settlement site says that effective August 4, 2026 Capital One increased the 360 Savings interest rate to match 360 Performance Savings “notwithstanding that Capital One's obligations under the Settlement Agreement have not taken effect because the Settlement's Effective Date has not occurred,” that “No Class Cash Payments will be paid unless and until the Effective Date occurs,” and that the administrator cannot estimate when class members might be paid. The class covers 360 Savings holders from September 18, 2019 through June 16, 2025; no claim form is needed, the deadline to choose electronic payment was March 30, 2026, and checks of $5 or more are mailed to the primary account holder's last known address otherwise. The settlement site lists the notice of appeal as June 18, 2026; the docket entry used here is dated June 17, 2026.

2019 data breach, Canada (proposed settlement). The settlement website for the British Columbia class action (first notice published July 13, 2026) says the parties entered a settlement agreement that is subject to court approval; that if approved, Capital One would pay $35,000,000 (Canadian class members outside Québec who received a breach notification letter; claim forms are filed only after approval); that “Capital One does not admit and denies any wrongdoing or liability”; and that the approval hearing was set for September 22, 2026 in Vancouver (opt-out and objection deadline September 11, 2026). As displayed on October 6, 2026 the site still described the hearing as upcoming and reported no ruling; no outcome was confirmed in the sources checked.

Credit reporting class action (Kromrey v. Capital One, N.A., E.D. Va. No. 3:24-cv-575). Plaintiffs allege Capital One violated the Fair Credit Reporting Act by failing to investigate disputes by credit card holders who say they were erroneously reported as deceased to the credit reporting agencies. The settlement website says Capital One “denies the Plaintiffs' allegations and denies that Capital One is liable,” that the court “has not decided whether either side is right or wrong,” that the settlement fund is $2,400,000, and that class members need not act to receive payment; it lists a final fairness hearing on March 20, 2026 and the effective date as “To Be Determined.” The site does not report the outcome of that hearing, and the status was not confirmed beyond the site.

CFPB v. Capital One, N.A. and Capital One Financial Corp. Filed January 14, 2025 and voluntarily dismissed with prejudice on February 27, 2025 (see the regulator actions section).

Other matters. The 10-Q also describes the long-running interchange fee litigation against Visa, Mastercard and issuing banks including Capital One (merchant-side antitrust claims), a lawsuit by Capital One, N.A. against the FDIC over a deposit-insurance special assessment, and, in a section on “fair access to banking,” a pending civil lawsuit by the Donald J. Trump Revocable Trust and affiliated entities. These are not consumer account disputes and are not summarized here. The 10-Q says the company's reasonably possible losses above its reserves for legal and regulatory matters are up to approximately $300 million.

Is Capital One Legitimate?

Capital One Financial Corporation is a Delaware corporation headquartered in McLean, Virginia, with its common stock listed on the NYSE, and it files annual and quarterly reports with the SEC (Form 10-K for 2025 filed February 19, 2026; Form 10-Q for June 30, 2026). Its principal operating subsidiary, Capital One, National Association, is a national bank regulated by the OCC, the FDIC and the CFPB according to the 10-K. BBB lists the McLean headquarters entry as BBB Accredited with an A+ rating, and the same BBB page (and BBB's Richmond headquarters profile) shows 16,991 complaints in the last three years and a 1.14 out of 5 customer-review average; Trustpilot shows 1.2 out of 5.
