Ebay Internet fraud & theft Sold damaged & incomplete merchandise Refused refund ripoff

Purchased item from ebay seller with ebay screen name "oneofadozen" on May 14, '07. I sent postal mo in amount of $87.65 May 15, '07. Item was in fact packaged very well, wrapped in bubble wrap & placed in oversize box cushioned with crumpled up newpaper to protect it. Therefore damage did not occur in shipping, I still have the packaging as proof. When item was removed from packaging I immediately noticed damage and missing part. The item was an antique dealer promotional Cadillac model car from 1968, see ebay item #190110039510. Please note seller had a decent enough feedback rating, however the negative feedbacks which are listed complain of the same fraudulent tactics also used on others. As a buyer when viewing the 2 pictures she took for her ad/description the car looks ok. Important to note that another ebayer asked her a question regarding the model being complete or missing anything. Her answer was "I dont see anything missing". However the piece missing was a 1" long chrome piece on rear of car, drivers side. It was the end of bumper which also houses the tailight. This would be obvious to any one who looks at the model including the police officer I called to my home to view it as he filed an internet fraud report.

Also the model had damage in the form of a small crack on the passenger side of the roof above top of windshield glass, where it meets roofline. You can see this very faintly if you study the picture long enough only if you have the model in hand to compare it. Also the thin passenger side vent window post was split in two. All of these defects are perfectly visable to anyone who looks this piece over. When I emailed her to request a refund she very rudely stated "no refunds, sold as is". She tried to claim that I probably dropped it and wanted my money back for that reason in other words refuses to accept the fact that she was caught committing internet fraud. I have all the evidence to prove my case. As I mentioned above, others have also run the same problems with her. Ebay does nothing about it, Square trade does nothing, Law enforcement here cannot do anything because she is several hours away and Marshfield Wisconsin law enforcement wont do anything because crime was committed here in my county via internet sale. I also filed a complaint with the Internet Fraud Complaint Center, have not heard anything either. If I take it to small claims court they want $85 to file and because she lives in another county I must deliver papers to her county and then pay her sherrifs dept. $30 plus to deliver it plus trip charge just to get her to have to appear in court. And if she chooses not to appear which most likely she wouldnt do, Im out even more money. Lastly, another ebayer who was ripped off by her has the screen name "lilac_gardenia" If you look her up also on ebay she advised other ebayers to email her for details of her incident with the individual. She also knows of others being scammed. Anyone who can help, please do. Thank you.
