I am a seller on ebay, it is my part time job. My approval rateing/positive feedback was at 94%.in over 2years I have had two negative feedbacks. One was the box I shiped the item in was not the origional box. I offered a refund but the customer passed and kept the product and just left us negative feedback.

The other was a buyer that claimed I sold them a faulty product. The product was a automotive diagnostic tool for diesel trucks or certain make and model.
As per agreement when I sold the tool to customer they have 7 days to report any problems. Customer waited almost 3 weeks and then contacted ebay and said I sold them a faulty product.

I contacted the customer to find out what was wrong and why they did not contact us in the 7day time frame so we could refund their Money.

They said they wanted to have the tool checked out by the manufacturer. And they say the manufacturer said the tool was damaged and could not be repaired, but they would sell them a new one.

Now the customer 3 weeks later is complaining to ebay I sold them a faulty product.

I offered the customer to send the tool back to me so I could check it out and if it was not damaged in shipment and did in fact worked. That it was probably just the fact they were useing it on the wrong Truck or Model or application.

Customer has not answered, and ebay has suspended our account and refuses to activate it until we resolve the problem with the customer by refunding their Money.
I am a Technician 25 years and work at a Ford Dealership. The tool worked I know because I used it and tested it before I sold it on ebay to the customer.
I suspect it was damaged in shipment and told customer they needed to put a claim against U.P.S.

Ebay will not listen to my appeal, or re-instate my account though.

Even though when I sold the Item on ebay it stated in the gurantee clause that we would refund money for defect items if returned in 7days minus shipping costs.
Customer did not ask for shipping insurance either so if it was in fact damaged via U.P. S the dispute should be theirs not mine.

I have asked Ebay to provide me with what proof they have that I violated any of their policies or terms. They do not respond and keep saying they will not restore my account until I refund the Money too the customer regardless if it was damaged in shipping or by customer, or even if the customer did wait 3 weeks before complaining. The customer can basicly do whatever they want, ship the item to someone else, etc, and its Ok.

Seems Ebay does not care what the circumstances are, if your a seller the customer can damage the product, or break the agreement, etc, and if you don't refund their Money ebay will suspend your account.

I reccomend any who have any other means of selling your products do it in yard sale, or find another auciton on the web. Ebay does not protect or work with the Seller obviously.
