My father past away June 20 and had no assets other than a truck he had a loan for through Citi Financial Auto.in dealing with his death and taking care of his business with Citi Financial Auto it was decided by the lender to reposses the truck since there were no other assets meaning no estate for my father. After months of dealing with the back yard lender the truck was finally repoed and I thought it was over. That was just the beginning.
The truck was taken to an auction and sold for much less than what was owed. It then received a bill from Citi Financial Auto for the balance of the truck loan plus the repo charges. Once I received the bill I wrote Citi Financial a letter stating there was no estate and that the account was handled in the manner chosen by Citi Financial.in return I received an appology letter for the way the matter was handled and again I was relieved in thinking it was over.
Phillips And Cohen And Associates purchased the account from Citi Financial. When I received the first letter by mail I called and explained there were no assest therefore there was no estate and no money to pay the balance. I explained the situation to them with Citi Financial auto and was told by the gentleman how Citi should have handled the situation and that he was going to take care of it. A month later another letter however this time I didn't call as I had already done that.
Sitting at home the phone rang one evening and on the other end was a very nasty woman insisting to know who I was and if I was in charge of the estate. I told her there was no estate. She then asked me if I buried my father. What kind of question is that. I could not believe how nasty she was and truly feel she and the company she represents are nothing more than bottom feeders that prey on those grieving.
The following evening I again received another call from the same company however it was as different lady. She was nice however still insiting on money even though there is no estate. I told her that his family is not responsible for the debt and that I had no interest in paying it. She went on to tell me "Mam you would be surprised how many families pay the balance and I am not sure why". I told her the reason would be from feeling that was the only solution to create peace in ones life. You think if you harrass someone long enough they will pay to be rid of you. Good luck in finding an asset because there isn't one and do not bother me with this anymore."
Those of you that run into this company beware that the families are not responsible to pay the debt if there is no estate. They threaten to look into the asset search and that if one is found how it will be taken to court. Go ahead throw more good money away after bad. After all a percentage of nothing is still nothing when no money can be collected.
