My home was sold to Fairbanks National Corp from Nations Credit. We did not recieve notice of this and it took me weeks to get the information just to make a payment. Fairbanks would not talk to me unless I knew a first and last name, so I made one up to get in (it worked.) I talked to Rachelle Lake.
My story is complicated because I am currently in a mold claim, gone bad. I've been out of my house for a year and it has been destroyed by the insurance company and those who supposely remediated it. I currently have been forced to move back in and there is more mold than every and I have bad reactions to it, nose bleeds, chronic diarrhea, etc.
We could not afford to pay rent and our Mortgage, so we moved back home, no kitchen, no walls, no sink, no carpet, no heat, and all of our destroyed contents around us.
We also had to file bankruptcy, 4 years ago due to my husbands massive heart attack, with no health insurance - it would have been effective that day at midnight.
Anyway since moving in I recieved a Motion to lift stay because Fairbanks is saying I have missed 12 payments. I have never recieved any payment coupons or notices or anything from Fairbank period. I have proof of all my payments but my attorney says its legal what they are doing.
So you mean to tell me they would let someone not make 12 payments. I have always called in my payment over the phone by check to ensure it was received. I would even pay a 15.00 fee to do so. I thougt it was worth it. What a joke.
Somebody needs to protect us and all the others this is happening to.
Something about rolling my payments over and charging enormous late charges, thus we are making payments but they roll back and charge late fees. We do admit to missing two payments, due to my husband being diagnosed with bladder cancer, and my parents house burned completly to the ground on Thanksgiving week, and of course I tried to call in payment after fire and they would not accept it.
I thought I was having a nervous breakdown, how could this be happening-I made my payments! And it was not easy but I did it. Now I am going to lose my cursed, mold home and everything and have to file Chapter 7.
A few months ago we were approved to refinance to fix the cracked foundation before we build back and pay off our bankruptcy. How could that happen if I missed a Year of payments and I have only been with Fairbanks 8 months.
I called Nations Credit to get a payment history, I told
them I was sold to Fairbanks can you still pull my records?
Carlos at Nations said yes, he looked it up and said it
had been deleted and he would call me back. After 3 days
and me calling back every 3 hours all day, his reply
was your mortgage was sold to Fairbanks we do not have. What I said we discussed this and he hung up.
You know damn well they would not go a year without a payment. This also will affect my fight with the insurance company because we are claiming the house as a total loss. But now I have no house-they should start the Foreclosure this week.
I am very afraid. Why us? Somebody, anybody, Please help me if you can-information-advise-Oh yeah, by the way I have 26,000 in escrow that Fairbanks lost and could not find. It is for repairs to our home, which I am sure they will find and keep.
