We also are going through the same situation as many of you. About 3 years ago our mortgage was sold to Fairbanks Capital Corp. And from the very beginning it was a nightmare. From the very start they have said that we were behind and yet do they say or show that we are current.
Our mortgage was 100,800.00 in the beginning and when they bought it it was at 100,536.00 and for the last 3 years it has stayed the same even though we have made all the payments payed outrageous late charges and all the other fees they could come up with. We also like so many of you had to file chapter 13 in Dec. Of 2000 just to save our home, yet that has not stopped them from trying to take our home. Twice Fairbanks has petitioned the court to remove the stay so they could forecloseon on our home, and both times we paid 3,800.00 and just last Oct. 7,300.00 to their attorneys to stop them.
We also went through a forbearance before we filed chapter 13 but we just couldnt make payments of 994.00 every 2 weeks who could? In Dec. We tried to get a pay-off so we could refinance well Fairbanks charged us 35.00 dollars for a pay-off that was 9,000.00 more than what we originally borrowed. When they took over the loan it was at $100.536.00 and they claim our pay-off 3 years later is 109,00.00 that math doesnt add up.
We also have an attorney now and they are working to get us away from Fairbanks so we can refinance before they try something else. Fairbanks has a website that you can go to and check your acct. Go to www.FAIRBANKSCAPITAL.com a customer care page will come up click customer then ckick my home loan and log in, follow the inst. And put in the info it ask and it will pull up your acct. History according to them. It will show were they have put all your payments and make sure you print them out for your records or to give to an attorney as we have. Dont be surprised if they have put all your payments in a suspense account like they have ours. When we got our interest statement for 2002 they said we had paid 13,960.00 in interest and not one cent had went towards the princ. Thats right 0 dollars and o centsthis has got to stop.
