Fraudulent subtraction of prepaid minutes. Nationwide

Cingular prepaid phone accounts have a standard practice of pre-empting all dialed calls from cingular prepaid accounts when the prepaid account is at $5.00 or below. This is done at the account holders expense.

As all calls are rounded up to the whole minute (per contract), this will always cost the account holder between 10 cents and $5.00 depending on the account holders use of the phone. If the account holder made one phone call that used all of the remaining minutes on their account than, they were fraudulently billed 10 cents. This is the minimum of the fradulent charge. It is actually possible to fraudulently charge an account holder up to $5.00.

All prepaid phone cards regardless of the subcontractor that they were purchased from, fail to state that the minutes are the property of Cingular rather than the property of the account holder therefore, the minutes are the property of the account holder/purchaser.

Cingular, by written agreement on the obverse and or reverse of all prepaid phone cards has no legal right to interupt the phone call of the account holder at the account holders expense. As the minimum amount of 10 cents is easily over looked by any individual or account holder it has been allowed to progress to a point as to witch an amount likely totaling thousands, if not millions of dollars has been fradulently accrued by Cingular.
