Claimed payments were not made but I received them back in the mail after they held them for two weeks

I traveled to New Hampshire to the old farm for the "sugar season"I paid the mortgage for the month I was gone, while I was there. I had a stroke and was in the hospital. HomeComings called on my cell phone to see what happened to the previous months payment. I told them i was in the hospital in New Hampshire and could provide the copy of the cleared check the next day.

She (customer service) asked when would I be able to do that? I asked her if she understound geography? I explained to her the mortgage, checking account, and bank was all in Texas, i was in New Hampshire. "I can not simply go out the door tomorrow morning and get a copy of the check it is two thousand milesa away. She did not seem to understand and thought I was being rude and evasive.

She said now you are disabled "you are a bigger risk to us now. How are you planning to pay the mortgage. I told her "don't worry about it until i don't pay the mortgage""you're a bigger risk to us now we need to start foreclosure proceedings" i told her to do what she needed to. I still had money coming in from rental properties and some other accounts payable so i continued to send the monthly payments. They kept sending them back after holding them for two weekswith aletter say they could not accept the payment because foreclosure papers have been started.

I got a letter from their attorney to answer the foreclosure claim to the county court. They provided the address. I sent a letter to the court disputing the claim pf non-payment. And sent copies of the returned checks, postmarked envelopes and their letter. Bi got it all back from the county court stating the foreclosure was not in their jurisdiction, So Homecomings sent me a wrong address where they filed the forclosure papers.

I did not act to agg ressive to get this straightened out. I thought there would be no way I could be foreclosed on while i was paying the payments. Well I was wrong next thingf i know i was getting the legal notices on the door about moving/evicting. I took all the papers to an attorney Robert Kizer in Bastrop County, TX. He was working it, but every time i saw him he needed $1500 last time it was $2500 i could no longer keep dumping money into a lawyer.

Now i wonder how much money Homecomings got out of this house. I paid $960.00 for ten years. Then they were paid the H.U.D. Guaranty loan amount. Now i suppose they got some of the "bail-out" money. If the president and law makers really want to improve the economy. Find a way to bail out all us who got foreclosed on. Especially those who had catistrophic illnesses, or life changing things out of their control.

I also think if the government held properties were offered back to the foreclosed families and we send the payments to the treasury dept. Or other Government departments. We could get lots of the interest money to help cover the cost of the "bailouts". My credit reports still has the accout with homecomings as active and a "balance due".
