In reviewing my credit I noticed that Bank of America has placed derogatory information on my personal credit file. The listing reflects a credit card account with Bank of America. I have not had in the past nor plan to have business with Bank of America.
I demand that this information be removed from my credit files with all three of the major credit reporting agencies. I believe this gross and reckless incorrect reporting is a violation of the Fair Credit Reporting Act on the part of Bank of America. Section 1681s-2 (b) of the Fair Credit Reporting Act creates cause of action for a consumer against a furnisher of erroneous credit information (Nelson v. Chase).
Anthon Ellsworth of Bank of America sent me a copy of a credit application which clearly shows a forged signature in my name. Mr. Ellsworth stated that he will not correct this fraudulent information and I would need to contact the collection agency to whom the account was sold in 2004.
This is a fraudulent account and I demand it be removed from my credit files immediately.
