Phone Sent for Repair Never Returned But Plan Still Charged

I left Cingular wireless about 6 months ago due to bad customer service only to fin my self back after ATT merg ATT asked me to send my broken phone in to have it fixed they said to buy new phone and would get refund after mine came back never got my phone and they still charged me every month for my plan now im back to Cingular so they want me to honer ATT contract with them but they say I have to deal w ATT over my phone and charges??? Sorry to say I was right bad customer service
