T-Mobile did not ship the phones I paid for, kept charging me for them and excluded document in Court

I ordered two phones from T-Mobile on the web and order indicated the phone would be shipped the same day. Two days later I tried to track the package and found that the package was intercepted by T-Mobile and sent back to the shipper. While they had already charged my credit card for the phones.

I called T-Mobile and inquired about the phones. They indicated I needed to go to a store and provide additional information. I told them based on my experience so far, I would like to remain with my current provider and asked T-Mobile to cancel the order and refund my money.

Two weeks later I received portion of my money back. Although I was not happy that I had to pay $19 for shipping, I let it pass.

Approximately 45 days later I noticed a charge for $243 on my debit card for T-Mobile. I contacted T-Mobile and asked why they had charged my account.

T-Mobile indicated, these were my monthly charge for cellular phones. I told him I had no phones and order was canceled. I never established an account with them. T-Mobile said that the account was activated. I asked him, how could I activate an account without phones. He indicated it was off line activation, however, he did not know what that was. I asked him to investigate for fraud, since someone had accessed my login to activate.

They indicated that they would look into refunding my money. I then canceled my account with the bank and initiated a fraud and dispute with my bank on those charges.

T-Mobile told my bank that charges were accurate and I did have a two year contract with them.

Next I begun to get collection phone calls from T-Mobile. I told them the same story, that I did not have an account and they should go back to their notes.

Phone calls from T-Mobile continued and became more frequent.

T-Mobile now wanted approximately $800 from me for services that I did not have. I begun a complaint with state consumer protection agency and provided document of equipment intercept as well as charges, my call logs from my current cell phone provider which clearly indicated a call to UPS and T-Mobile on October 1st.

T-Mobile was then generous enough to back out the cancellation fees and set my account balance to zero. But they did not pay me back for shipping of $19 and first month service of $243.

Next I filed small claim suit and requested documentation. They provided the call logs and excluded one page for October 1st which I had called in. From they documentation they had provided I composed a list of questions for T-Mobile to answer under oath. One was that if these were the entire call notes for this account. They indicated yes. We then asked explanation of what was no install project in their notes. They indicated that it was cancellation during the customer right to cancel time. Which is three days in Florida.

Bottom line is that they lied in court and in the documents under oath. They indicated in the court document and to the attorney general office that the account was canceled on Nov 23rd. Even though it was canceled October 1st.

The judge in my case is unwilling to hold them responsible for the damages I am seeking for the collection calls. I wanted to teach them a lesson.

Just think if they charge one million people $19 for shipping and 243 for first month charge. This will be $262 per person and total of $262,000, 000 annually.

The judge is wrong and is not paying attention to their lies on their court document.

Judge said I could not seek damages on fair debt act because they have their own collection agent and they thought this was good debt. We have another hearing so that I can prove they have not paid my back the $243. Even though I have proof they took the money. I have to prove they have not paid me back.

I could use some help. I am out of pocket around $1000 so far and would really like to expose them and teach them a lesson.
