Momentum Direct commits consumer fraud by submitting unauthorized checks to your account in violation of their "Free Trial Period Terms and Conditions." The sales people tell you that you will receive a Free Trial of Momentumdirect's Diet Product. The only condition is that you pay the shipping cost of $7.95.
The shipment takes over one month to arrive. Enclosed in the box is the Shipping fee invoice of $7.95 and a pink form describing Terms and Conditions of the Free Trial to which the consumer had not agreed in advance. The terms state that the consumer has 14 days to try the product. If not satisfied, the product can be returned and there is no charge.
The postmark on the package from Momentumdirect was marked January 8. I received the package on January 11. My account was debited $49.95 on January 14 (three days after the receipt of the product and 6 days after shipping) and $58.93 on January 16 (5 days after receipt of the product and 8 days after shipping). I only received the FREE introductory product and have received no additional product for which I was charged. (The first product was supposed to be free).
I have notified my bank, which will be conducting a fraud investigation and reversing the debit. I never authorized the checks.
The web site says that to cancel your account (which I never opened), the consumer must call their 24 Hour Customer Service Number (281) 356-1405. It is not a 24 Hour Number, as the message stated that Customer Service is opened Monday through Friday only. I have sent them an Email with documentation of the dates the product was shipped and the debits to my account. Because these charges were unanticipated, they resulted in overdraft charges as well.
I would suggest that consumers not purchase anything from this company.
