Breach of Contract After Receiving 95% of Payment

I entered into a contract with Dan Casey, who called himself Dan Baird at the time, the end of May. Mr. Casey detailed in the contract specifically all work to be done, equipment to be used and payment scheduled. Mr. Casey collected 50% upfront and was to begin the work immediately and estimated the time to be 3 to 5 days. Mr. Casey began the work fine and seemed to be attempting to complete everything within a week. Mr. Casey stated he was going to be wrapping up all work shortly (and even brought in more equipment and another worker) and asked for additional money since he would be finishing. I paid Mr. Casey again (writing the check again to Dan Baird). When I returned home that evening, all Mr. Casey's equipment was gone and my check had been cashed at my bank. Almost $6,000 has been paid directly to Mr. Casey and it will cost me an additional $1500 to have "some" of the work completed by another company.

Over the next 30 days, when Mr. Casey did actually respond to my list of items he had not completed and questioning him about why he never showed up, I got a laundry list of excuses, but always the same "I will get it all done". It wasn't until I specifically told him I was filing a court action that Mr. Casey set a deadline of July 10th to "complete" the job as he had indicated in his contract and agreed to several times in writing. Mr. Casey returned on July 9th for a very short time, but did not complete the work - or even come close. Mr. Casey refused to fulfill his contract and even asked for more money. Mr. Casey has also refused to provide me with any receipts for the items stated on the contract.

I have a court case against Mr. Casey scheduled for August 6th and have contracted with another company to do only the work not completed by Mr. Casey in his contract. Mr. Casey has failed to respond to my requests for a refund, based upon the costs I have incurred from the new company.

In checking the open court records in only Johnson County (other counties are providing there records this week), it appears this is a consistent practice of Mr. Casey's, with multiple criminal and civil cases in his name.

I have placed an ad on the Kansas City Craigslist should anyone like to communicate with me regarding this company. I would like to see some legal action taken to prevent others from falling pray to his unethical, immoral and fraudulent activities.
