I filed bankrupcy and included my mortgage in the bankruptcy which was discharged January However, currently there are funds in my savings which they will not let me withdraw because they claim they will be applying it to the mortgage which is still in foreclosure. (which, again, was discharged in the bankruptcy).
In essence, they are forcing me to make a payment on a discharged loan. I spoke with my bankruptcy attorney who told me they do not have the right to do so since the mortgage was discharged. She told me to have Eastern contact her. I gave Eastern my attorney's phone number. I also left several messages with Eastern foreclosure attorney requesting a call back. I have not heard back from either and neither has my attorney.
In the meantime, I still cannot withdraw my funds.
The reason I was placed into forclosure was due to several misapplied mortgage payments which went to various loans I had with them. They took the liberty (WITHOUT MY KNOWLEDGE AND CERTAINLY WITHOUT MY CONSENT) of unapplying my mortgage payments only to post to other loan accounts which I believe was to keep their a/r to a minimum. This occured right before the "merger". I sent Eastern spreadsheets of what was misapplied and requested they take me out of foreclosure until the mess is straightened out. They refused to stop the foreclosure.
I personally know of one other person who also had accounts with Eastern who have had similar, if not the exact same thing happen to him.
