I have read most of these reports and am in the same situation as most of you. I too filed for bankruptcy in Aug of discharged in November. Made all payments on time, they TOOK my paymenst while in bankruptcy which I am told was illegal. My attorney went in front of a judge with GMAC's attorney to fight foreclosure, the judge denied them their motion because I have thousands in equity, they want the house, they don't want me to have it.
Once the bankruptcy was discharged the nightmare started, foreclosure proceedings. Went through loss mitagation, what a joke! Payments doubled (actually more than double) cannot get a breakdown on fees and still haven't to this day even though I sent a letter demanding such under the RESPA Law (certified letter). Made the outrageous payments but stipulated on the repayment plan that I would only do so until a resolution was made.
Lost my job in April, called them to adjust the payments because we only had my husband's income. Once again went through the hassle giving them my whole life history, payments went over and above the original agreement! Once again, no justification. Mind you, it took them 3 months!!! To get their head out of you know where to get back to me.
Finally, I filed a complaint with HUD, they put me in touch with The Office of Financial Services in my state (they regulate their license). Their 21 days are almost up, in the meantime they sold my home! I have until Jan of 08 to be out, I have wanted to give up so many times, I'm a little fish in a big pond and they have more capital than I. I will keep you all posted on what happens...
