Deceptive loan and Identity Theft

Went into the 96th st office of Wells Fargo in Indianapolis, Indiana in March to inquire about a new car loan. Was told that we were approved. Office manager Lisa suggested that we look at their website of repossed vehicles to see if we could find something that was suitable for us. We had no problems with this as the previous vehicle we had bought from them was a repo.

We found a 2005 Nissan Xterra that we liked and agreed to purchase it. They had the Xterra shipped to the office location in Indianapolis and we picked the vehicle up and signed the loan papers. We were also told that the Xterra was checked by a local Mechanic and the vehicle was found to be in perfect running order. From the beginning we began to notice small problems with the Xterra and reported it to the local office and we were told that a extended warranty had been put the vehicle, however when we tried to use such warranty we found that none exisisted.

The problems were small and after looking at our loan papers we dicovered that there was no warranty provided. We accepted this and did all of the regular maintaince on the Xterra. On December 26th of 2008 while driving the Xterra the vehicle began shaking violently and we promptly took it to a Nissan dealer who ran a complete dianogstic and told us that the engine had blown. They also told us, after paying over $500.00, that the vehicle had been abused before we had purchased it and that if it had been inspected as Wells Fargo said it had, it would have been caught.

We had kept up with the regular maintance on the vehicle and had thew receipts to prove it. We called the 96th st office and told them of the situation. All we we wanted was a deferral for 1 month so that we could get the Vechicle fixed. They told us not to get the vechicle fixed that it would not be worth it. They, then, without our knowledge or consent contacted a local car dealer and arranged for us to buy a 2008 trailblazer.

The local office told us that we qualified for another car loan and that we could get the trailblazer with no problem and then just let the Xterra go back. They said it would only be a small hit on our credit rating and if we put a letter of explaination in our report it would all wash. Low and behold we were approved even though we are both on Social Security disablity with a small part time job as income.

Then the phone calls started. At first they we friendly and we explained the situation to them and they understood and told us that they did'nt want to hurt our credit because we had been such good customer with them (4 previous car loans before with not 1 late payment). They made arrangements with us to come and get the Xterra, but when the repo men got to our home to repo it they refused to take it because the vehicle would not run. This has happened twice.

They say since the Xterra does not run they will not take it as a repo. Repeated calls to the local office only resulted in just wait it out they will take it. Well today, 02/28/09, Wells Fargo called from their Nazi office and said that they do not want the Xterra, since it does not run, that they are going to write it off and put a lein on my home for the amont due.

We know that this is a scare tactic, as we already have engaged an attorney he has said that they might try this. They have also said that they will pull the money from our bank accounts, but according to our our bank they cannot legallly do this. Any way a block has been put on our account against Wells Fargo.

As far as idendity theft, we have found put that our loan papers do not match the loan papers that Wells Fargo has. The 2002 cavalair that we traded in on the Xterra is nowhere in the paperwork and has some how dissapeared. We also have a letter saying that we paid off a 2005 Nisan Pathfinder. Wells Fargo acknowledeges that there is loan papers for a pathfinder will not send us a copy the the paperwork.

It is also interesting that the entire office of the 96th st store was fired 6 months ago but they will not tell us why. Long story short, Stay away from these people, they are CROOKs!!!

WE think that they are just PISSED about the Vegas Vacation the had to give up!
