Overdraft fees. Wells Fargo's "Fees Questions" page, as displayed on October 6, 2026, says: "Our overdraft fee for Business and Consumer checking accounts is $35 per item" and "We charge no more than three overdraft fees per business day for Consumer accounts and no more than four overdraft fees per business day for Business accounts." Its "Overdraft Services for Personal Accounts" page says: "If we pay an overdraft, we assess a fee of $35 per item paid into overdraft," "We do not assess fees for returned items or declined transactions," and "We will not charge an overdraft fee on items that are $10 or less." The account agreement and fee schedule for your own account control; read them before disputing a fee.

Dispute deadlines. This page did not verify a specific number of days for disputing a debit card, credit card or mortgage charge with Wells Fargo. The deadline for a given product is stated in the account agreement and on the statement, so check them and report a problem as soon as you see it.

Outside complaint routes. The CFPB complaint page says: "Companies generally respond in 15 days. In some cases, the company will let you know their response is in progress and provide a final response in 60 days." Government actions: CFPB, OCC, Federal Reserve, Justice Department and SEC, 2016 to 2026 (status as of October 6, 2026)

The CFPB, the OCC, the Federal Reserve Board, the Justice Department and the SEC have each taken actions involving Wells Fargo. Each item below is taken from the agency's own page or order, opened on October 6, 2026; dates and amounts are as the documents state them. Allegations in a lawsuit are not findings, and an administrative order's terms are quoted, not paraphrased into new claims.

  • September 8, 2016, CFPB order (docket 2016-CFPB-0015): the CFPB page says the Bureau "fined Wells Fargo Bank, N.A. $100 million for the widespread illegal practice of secretly opening unauthorized deposit and credit card accounts" and that "according to the bank's own analysis, employees opened more than two million deposit and credit card accounts that may not have been authorized by consumers"; the bank also agreed to pay a $35 million penalty to the OCC and $50 million to the City and County of Los Angeles. The CFPB page lists the action's status as "Expired/Terminated/Dismissed".
  • April 20, 2018, CFPB order (docket 2018-BCFP-0001), issued in a coordinated action with the OCC: the CFPB page says Wells Fargo "violated the Consumer Financial Protection Act of 2010 (CFPA) in the way it administered a mandatory insurance program related to its auto loans" and in how it charged certain borrowers for mortgage interest rate-lock extensions; "The order also imposes a $1 billion penalty against the bank, $500 million of which will be remitted to the OCC." The page says the order was modified on December 20, 2022, and lists its status as "Expired/Terminated/Dismissed".
  • December 20, 2022, CFPB order (docket 2022-CFPB-0011): the CFPB page says the Bureau "identified multiple violations across several of the bank's largest consumer product lines", including, for auto loan servicing, "incorrectly applying consumer payments" and "wrongly repossessing borrowers' vehicles"; for mortgages, "improperly denying mortgage loan modifications"; for deposit accounts, freezing accounts in suspected-fraud cases when lesser restraints were available, "deceptive claims as to the availability of waivers of monthly service fees", and charging overdraft fees "even if the consumer had enough funds available in their account to cover the amount of the transaction at the time they made it". "The order required Wells Fargo to come into compliance with federal consumer financial law, pay more than $2 billion in consumer redress, and to pay a $1.7 billion penalty." The page lists the status as "Expired/Terminated/Dismissed" (page last modified January 28, 2025); this page did not locate a separate termination document.
  • February 21, 2020, Justice Department and SEC resolution: the U.S. Attorney's Office press release says Wells Fargo & Company and Wells Fargo Bank, N.A. agreed to pay $3 billion to resolve potential criminal and civil liability over a practice "between 2002 and 2016" of pressuring employees to meet sales goals that led thousands of employees to open accounts or products without consent; it says Wells Fargo "admitted that it collected millions of dollars in fees and interest to which the Company was not entitled"; the criminal matter was resolved by a deferred prosecution agreement with a three-year term, the civil claims by a FIRREA settlement, and the SEC matter by a cease-and-desist proceeding; the release says the payment "includes a $500 million civil penalty to be distributed by the SEC to investors".
  • OCC consent orders: OCC order AA-ENF-2025-13 (signed February 13, 2025) terminates the "Consent Order against the Bank dated April 20, 2018, AA-EC-2018-15"; OCC order AA-ENF-2025-19 (signed March 17, 2025) terminates a "Consent Order against the Bank dated September 9, 2021, AA-ENF-2021-29". Wells Fargo's February 2025 news release says: "This is the tenth consent order closed by Wells Fargo's regulators since 2019" (a company statement).
  • Federal Reserve Board, 2018 enforcement action: on June 3, 2025 the Board announced that Wells Fargo "is no longer subject to the asset growth restriction" and said the other provisions of the 2018 action "will remain in place until the bank satisfies the requirements for their termination"; on March 5, 2026 the Board announced "the termination of its 2018 enforcement action against Wells Fargo", saying the bank "had met all required conditions". Wells Fargo issued a news release on March 5, 2026 titled "Wells Fargo 2018 Federal Reserve Consent Order Terminated".
  • OCC Formal Agreement, September 12, 2024 (news release 2024-99): the OCC "entered into a Formal Agreement with Wells Fargo Bank, N.A." identifying "deficiencies relating to the bank's financial crimes risk management practices and anti-money laundering internal controls". Wells Fargo's Form 10-Q for the quarter ended June 30, 2026 still describes anti-money-laundering and sanctions inquiries and this agreement under 'Legal Actions'; no termination of the agreement was identified in the sources checked on October 6, 2026.

The same 10-Q says government agencies are conducting inquiries about fair access to banking, including under Executive Order 14331, and that the Justice Department and the SEC closed their hiring-practices investigations "without taking action". Wells Fargo & Company is a Delaware corporation and a financial holding company and bank holding company, with principal executive offices at 333 Market Street, San Francisco, California 94105 (Form 10-K for 2025, filed February 24, 2026). Its principal subsidiary is Wells Fargo Bank, N.A. ("the Bank"), which the 10-K says held assets of $1.8 trillion, or 85% of the company's assets, at December 31, 2025; the company reported approximately $2.1 trillion in assets and about 205,000 active employees, and four reportable segments: Consumer Banking and Lending; Commercial Banking; Corporate and Investment Banking; and Wealth and Investment Management. The OCC and CFPB documents above name the bank as Wells Fargo Bank, N.A., Sioux Falls, South Dakota, and the CFPB describes it as a national bank.

Wells Fargo's consumer products include checking and savings accounts, credit and debit cards, and home, auto, personal and small business lending (10-K, Item 1). Lawsuits and settlements: status as of October 6, 2026

Status is taken from the dockets and settlement websites opened on October 6, 2026, and from Wells Fargo's Form 10-Q for the quarter ended June 30, 2026, which says the high end of the range of reasonably possible losses in excess of accruals was approximately $1.5 billion as of June 30, 2026 and that the company believes outcomes will not have a material adverse effect on its consolidated financial condition.

  • McNamara v. Wells Fargo Bank, N.A., et al. (S.D. Cal. No. 3:21-cv-1245, consolidated with McCraner v. Wells Fargo & Co.): the settlement website describes a $33 million global settlement of consolidated suits alleging that Wells Fargo & Company and Wells Fargo Bank, N.A. assisted entities that "misled consumers into monthly subscriptions and products" by opening bank accounts and transferring funds; it states that the defendants "deny all claims and deny any wrongdoing or liability". The docket shows a preliminary approval order signed November 4, 2025 and an order signed March 26, 2026 granting the motions for approval of the class settlement and for attorney fees, with a judgment entry. The claim, opt-out and objection deadlines (March 4 and March 5, 2026) have passed.
