The NSF fee scam seems to be nothing new to this site. I was hit w / NSF fees as well. Nowhere on the statement that BofA provided to me does it show that my account was EVER in the negative until AFTER NSF fees were assessed for pending/unposted/unauthorized transactions. I was assessed $210 in two days.
I posed this question/scenario to the BofA customer rep who was refusing (surprise!) to reverse my fees: Let's say I have $50 in my account. I use my checkcard to pay for a $17 transaction, but the vendor submits the pending amount as $71 in error. The following day the charge is posted/authorized as the correct amount of $17. Would I still be assessed an NSF fee since the pending transaction originally came in as $71 w / only $50 in my account? Her answer was YES! She then went on to say that it would be MY responsibility to contact BofA to have them "investigate" whether or not the fee s/b reversed. She basically ended the conversation after this w / "I am limited w / what I can do for you".
Here are other scenarios that I would like BofA to confirm:
Let's say I have $50 in my account. I go to a restaurant & am charged $42 for the meal. I charge $48.30 ($42 15% tip), but (as many of us have seen restaurants do), the restaurant submits the pending transaction as $50.40 ($42 20% tip). Would I be charged an NSF fee for the pending transaction that's over what I actually authorized to be charged? Probably.
If funds from pending/unposted/unauthorized transactions are IMMEDIATELY deducted in full from one's current balance, then why are pending/unposted/unauthorized DEPOSITS not IMMEDIATELY available in full in kind? Debits & credits should be handled EXACTLY the same way.
What "services" are BofA truly providing to its customers? It is apparent that BofA customers are not given the benefit of the doubt in ANY circumstance. The burden of INNOCENCE is placed squarely on the customer. BofA isn't "in our corner" - they are the customer's opponent in the opposite corner of the ring!
