Well this is an update from before... Homecomings finally did it, we are now without a home for me, my husband, and my 8 year old little boy. We have fought with them since and I finally got a hold of an attorney that said just give them the keys and surrender the house. He stated that he has dealt with them before, and we are not going to win. He said that they deal within a hair of the law so no one can legally touch them. We have lived in our home for 17 years, and we have never had one problem until it was transferred to homecomings financial.
We did a chapter 13 bankruptcy in and paid every single payment. It was discharged by the federal courts in 2004. Oh, but homecomings did not see it that way, they said the trustees cannot be trusted and that we still owed them $5000.00.
Also since our discharge our payment went up 300 more a month. They said they would do an audit, which by the way took them 6 months to accomplish, and I might add during this time we were still making our house payments, which kept changing every single month.
Well when they were through with the audit, they said we owed them almost 6,000 now. They kept adding on corporate advances whatever that is, and our payments were getting way out of our reach, and we tried to file another chapter 13 just to keep our house, and homecomings sent a letter to the courts saying that they would not go along with a chapter 13 again.
To make a long story short, we surrendered our house, and then we get a phone call from homecomings wanting me to help them sell the house for them and contact a realtor. I will not type what I had to say to them, and they said that they would work with me, if I wanted to keep it... I stated like how you worked with me the last 5 miserable, horrible nerve racking years that we had to endure.
They have completely runined our credit, and now we are without our home. I sure hope that someone files a civil suit against them, and we want to be included. Please
