On march 25,1999 my wife & I went to the K-mart in Waynesboro, Va. To look for a bike for our son.
I was standing in the main aisle looking at their bike display (my wife was around the corner looking at other bikes), I was struck from behind by a stockboy pushing a heavily loaded, unguided cart.
This cart injured the back of my head, my neck, Dislocated my sacro-iliac joint (aggrevating a permanant disability) & sprained my ankle. The assistant store manager took the incident report, then gave me a piece of paper to give to the hospital. (paper was only good for the initial check-up & didn't even have K-marts name on it.
It took almost 2 years of treatment to be able to function somewhat normally. I went back to work (light duty) on 12/22/00 & found that while I could physically do the job, my ability to concentrate diminished & my organizational skills were completely shot. (I call it scatter-brained)
After about a month working, I started making calls, trying to find out who to contact at K-mart. I tried that number & could not get a live person on the phone until well after the statute of limitations had expired. (they made sure they pointed that out) & then said that it didn't matter because they were bankrupt & didn't have to pay.
They caused my life to fall apart, (& marriage too) they didn't pay any of the doctor & hospital bills (state of virginia ended up absorbing them (but will be held against me until paid).
Also, I never received a dime of the over $67,000 of lost wages, nor even an apology for causing me (& my family) a lot of pain.
