On Aug. 7th I received a letter dated 08/05 from a Tamara Swanson with AAM, LLC in reference to an alleged second notice of non-compliance/fine notification, $25.00. The violation was that I had left my trash/recycle can visible on 08/04. The problem is that I have never refused to comply with any notice of any violation. I called and requested a copy of the first notice of non-compliance for the violation for 08/04. They did not have a first notice for that violation dated 08/04 because one was never been written. They did have an earlier violation notice letter dated occurred 5 months earlier but the date of that alleged violation was for 03/03 and it was a different violation and had nothing to do with the current violation. Their claim is if they send you a violation letter for a tree that has been blown down is a wind storm. You remedy it by planting a new tree and 5 months to 5 years. Later the new tree is blown down is a different wind storm and they send you a notice for the second tree they can fine you for it. Or if your grass grows to tall and they send you a notice and you remedy it but the next summer your grass grows to tall again and they send you a second notice on the same issue even if it is one year later they can fine you. This is just a way for AAM, LLC to rip off Festival Foothills Community Association Home Owners.in other words a home owner can never make the same violation twice. Even is the those violations are months or years apart. AAM, LLC is not giving the home owner time to come into compliance before they fine them and that is clearly a violation of the law.
