I was diagnosed with a terminal disease (COPD). I contacted Capitol One customer service to make sure that I was indeed covered on my credit card. I was advised that I was, however, since I had been past due 30 days in the past 90 days, I was not elgible for the coverage until I had payed on the account for another year. My prescription bills had tripled and was not able to pay at that time. I later received a letter from Capitol One offering to consolidate all of my bills.in the letter it advised that I had already been pre-approved and had a confirmation number. I called to apply, but was turned down because they claimed that I had been 30 days past due in the past 90 days. Then later an offer came in the mail to refinance my vehicle and was again pre-appoved, with an confirmation number. I called and was once again refused.
I asked why the letter said I was pre-approved and had a confirmation number, the representative said that most of that was done by another company hired by Capitol One and there had been a mistake. Around March I called Capitol One and made an offer to pay the account if they would waive the almost 29% interest rate and waive over balance fees, late fees, but once again my offer was refused. Now I am being sued by Capitol One using Farrell & Seldin Law Firm, Centennial, Colorado, which has numberous complaints filed. I am scheduled for a pre-trial on December 22. I do not have any money to pay for an attorney so I am going to attempt to represent myself in court as I have a many years of experience of testifying in both criminal court and civil courts. Any suggestions! Capitol One Bank and the attorney firm, Farrell & Seldin needs to know that they cannot bully us around and get away with it.
