Incomplete, unfinished and substandard masonry and asphalt paving jobs

We are writing to inform you about a very bad experience we had with contractor Robert Mazzoli of J.T. Mazzoli Pavement Company, Inc. Of 9 Landings Lane, East Patchogue, NY 11772. On September 15, we hired Mr. Mazzoli for two jobs: one driveway pavement job, and one brick walkway and steps job. His work was substandard and incomplete.

Our contract specified that the old asphalt in the driveway be removed, including two sections of Belgian blocks. He removed the first section of the Belgian blocks. For the second section and the rest of the old asphalt area beyond that, he poured and covered that area with a new layer of asphalt without consulting us beforehand. When we found out this the next day, he repeatedly told us that it was for the good of the driveway and that the old layer was too difficult to remove due to the thickness and that it is already a third layer. His explanation was that he has no truck, and he just borrowed it on the first day. We repeatedly requested Mr. Mazzoli to redo this portion of the job but he refused each time. Additionally, the paving itself was substandard. There are several cracks and grooves throughout the length of the drive way. The new asphalt looks worst than the old asphalt. Finally, he agreed to repave these areas, but has yet to do so.

He paved our driveway on Friday, and instructed us to refrain from driving on it for one day. We complied, and even parked our car on our friend's property for the entire weekend. Yet the day following the laying down of pavement, Mr. Mazzoli and his workers transported rock-filled wheelbarrows up the driveway seven times, leaving marks in the pavement. We complained about this. We had even told him that we did not want him to work that day, but he disregard our request. Plusin the subsequent certified letter he would write us threatening to sue, he states: you were given instructions to stay off of the area seven to ten days. Imagine, he is telling us not to use the driveway seven to ten days, while he and his workers drove on it the next day.

Mr. Mazzoli's bricklaying job was also substandard. He has refused multiple requests to replace the twenty-five bad bricksbricks which had unacceptable cracks and holes. Regarding the brick walkway, he cemented only the left edge at the start of the walkway but not the right edge. It is small, but unsightly, and we have disguised the error with rocks. He also failed to flush one of the lowest brick steps. A technician from Verizon later tripped on this step when repairing the optic fiber that Mr. Mazzoli broke. He said we don't need it and only a stupid guy will trip.

Mr. Mazzoli should have finished the walkway first before working on the asphalt.instead, he demolished the deck at the same time he demolished the driveway. He also reused the old asphalt for the walkway. All these created more problems. Because of frequent deliveries driving through the new asphalted driveway, all the cracks became much more pronounced and larger. We told him these problems and he blamed we were the one created these as we were the one driving on it several times.

In addition, we also ordered extra 5 cubic feet of stones for the garden, and he covertly used most of them for the walkway job which we already paid. He took the remaining stones, which we had already paid for as well, secretly back to his vans. We asked one of his workers about this, and he told us those bricks actually belonged to us. When we questioned Mr. Mazzoli, he said those unused bricks belonged to him.in essence, he not only reused some of the old bricks by facing the old bricks upside down into the new, but has also stolen multiple extra bricks and stones which we have already paid for.

Despite failing to receive any of our countless attempts calls to return for finishing the work, he has ordered us to small claims court. We paid Mazzoli (two checks of $7000 and $7345 for a total of $14345) 85% of the fees are holding the remaining ($2650) 15% as a balance, which we will pay him upon completion of the projects.
