EEOC Why Doesn't EEOC Penalize Companies Instead of Pushing Mediation? Overland Park

After filing a recent gender discrimination charge against the large engineering firm I work with, I was informed by the EEOC we would be "mediating." I learned that mediation is where the company has a chance to settle with you.

After explaining to the mediator that I had already discussed the issue at length with company representatives, and was more interested in going to court to remedy the systemic gender discrimination throughout the company, I was told my best course was to mediate (settle), as the EEOC does not have the manpower, and only investigates. 001% of the cases!

I was also told by the mediator there were 6 investigators for 1,600 cases. It is obvious that since the EEOC does nothing to the employer, the employer continues to discriminate, and the resulting victims file even more cases.

The firm I work with has had 2 age discrimination lawsuits within the last 6 months - that I am aware of - that were settled.including my gender discrimination charge, this totals 3 charges. Does this not alert the EEOC to actually investigate the company's practices? Nope.

It would appear the EEOC is simply assisting companies in locating their "problem employees." The company discriminates, the employee files a charge, the EEOC notifies the company of the charge and who filed it, mediation occurs, and the company knows which employee to get rid of next time around!

From what I can see, the American worker basically has no chance of having the EEOC actually penalize their company for even blatant discrimination practices.

The systemic problem at my firm has been ongoing for years. They win every time with settlements. The employee "goes away, " and the discrimination continues. Although I am willing to go to court, I have been told, in so many words, not to bother - that I will lose! And this is protecting the American worker how?

Discrimination is illegal. As is running a red light. When one violates a traffic law, they do not get the chance to "mediate" with the police officer writing the ticket. Why are companies who break the law given this privilege?
