I went to the BOA atm at penn station plaza in NYC. Attemped to take out 20 dollars from an ATM for which it told me i had insufficient funds. I didnt know why i had insufficient funds so i tried to get a mini statement for which it then told me i could not do. Then when i went home my account said that i had took 300 dollars from that same ATM for which i had never even attemped to take out. I went to my local BOA in Amherst for which they said they couldnt do anything until the transaction went through.
Then when the transaction went through i went back to the BOA for which they connected me to the fraud department. I then argued with teh fraud department person who said that there was very little chance that the investigators would believe me since the transaction occured 15 seconds after i transaction i said i did do. I then asked her why would the atm would deny my actually attemped transaction but then somehow let through a 300 dollar withdrawal. She then said that was something the investigators would have to look into. I then said that if it was very unlikely for me to get my 300 dollars back filing a fraud claim that i would rather file a ATM claim to prove that the atm was 300 dollars off. She said if i did not attemp to withdraw 300 dollars i have to file a fraud claim. The thing is i had my card on my the whole time and therefore i dont believe it was fraud because no one had my car and used it. I believe that it had to do with a faulty ATM machine. I evntually jsut filled a fraud claim for which they told me the results will be mailed to me in 45 days.
Then after i filled the claim the associate at the BOA i was at told me that the machine had first denied the 300 dollar withdrawal and then it approved it the second time due to a payover. He did not know what a payover is and neither do i. What i dont understand is why the atm machine would deny 3 transactions but then suddenly allow the 4th. Also i dont understand why they cant just look at the video camera's at the atm machine and see that i did not take out the money or even attempt to withdraw it. I also think that i was not treated with respect because of my age and the fact that it was only 300 dollars. If anyone has a suggestion to help me with this situation, i would appreciate it. Thanks.
