Rip off on negotiated price contract fraud guarantee not honored rude manager

We visited Alliance on Sat. 2/16 because we saw a new Tahoe that we were interested in. They were asking too much and just as we were about to leave, the salesman showed us a used 2008 Tahoe, supposedly GM Certified Used Vehicle, still under warranty and 3Day/150mile Satisfaction Guaranteed. I fell in love with the color and the fact that it was still under warranty, and with the 3Day Guarantee, I was hooked, what could go wrong?

They were asking $36,000 for the truck, but my husband would not take it, we could get a NEW one for just a bit more. They went back and forth negotiating, and finally settled on a price. The salesman had my husband sign off on the negotiated price of $30,697 TT & L, and they even through in free window tint, which they never honored. We were told Bank of America would be our financer, which was perfect for us since we banked there.

We were not given the contract that night because the power went out in the building. I returned on Mon. 02/17, I was only given a xeroxed copy of the contract. When I got home, my husband noticed the price on the contract was $36,000, we returned to the dealer and told the salesman if we could not get it at the negotiated price, we did not want it, (per the guarantee, we had every right). He assured us, he would fix it and to return back the next day.

We returned the following day, and were told that they were not going to change the price nor honor the 3 day guarantee. We were treated VERY rudely by the Manager, he told my husband he had signed the contract and nothing else could be done. He asked us to leave. We called Bank of America to advise them so that they would not finance us and were told that they had denied us. Well, we knew that we would have to sign another contract, but we were wrong.

We recieved a letter from Suntrust Bank, they had taken our loan. My husband told them that he had never signed a contract with them, they said he had. We requested copies and sure enough, the contract had been altered without our knowledge, payment and interest rate was different too. How can this happen, how can they just change a contract like that? The manager at Alliance told us he could do whatever he wanted because he was the manager.

Now, we are having problems with the truck, it has left me stranded twice, has been in the shop 3 times, and I have a son who is a patient at Texas Childrens Hosp. Cancer Center, and no way to get him there. I am upset that we could get treated like this.

Now they are taking us to court for a stop payment we made on the deposit. They have a nerve. We need help, because our son is ill, we do not have the money to pay a lawyer, we got the vehicle because we needed something reliable to get us safely to the hospital, which is about 40 miles from where we live, for my sons treatment. What can we do? They refused to honor the guarantee, and they altered the contract, who do they think they are?
