Brown and Brown
Nissan is a rip-off fraud

I recently purchased a 2001 Nissan Frontier pickup truck from Brown and Brown Nissan in Mesa, Arizona. The price on the window of the truck was $14,995.00. The truck is white in color and has a 6 cylinder engine. I told them that I didn't have any money for a down payment until my I got my tax return. They said that was fine. They said they would hold my check until I got my tax return the week of March 7th. So I wrote them a check for $1,500. They also wanted a check for $250 until I found my title for the Eclipse. Which I have since mailed to them. However I still don't have my $250 check back for the title.

The truck I purchased was a used 2001 with only 7,000 miles on it. I traded a 1997 Mitsubishi Eclipse RS. I still owed $11,000 on that vehicle.

When they printed out the purchase order, the order stated that the vehicle had a 6 cylinder. I was unaware that the vehicle had only a 4. I found this out later.

They had also changed the price on the truck from $14,995.00 to $21,410. It also said my trade-in was worth only $13,000, probably more.

Brown & Brown said that I still owe $11,000, which they were paying off the balance, that was a lie too! After interest the cost of the vehicle was $34,997.27!!

They also had me financed at 15.5% interest. I have a mid 600 iSAAC score rating for credit they said, but that might not be the truth either?

I still do not know who the bank is. Another piece of paper that says the actual price of the truck which is $14,995, also says that they have a 3 day/150 mile money back guarantee. So when I called and told them the next day I did not want the vehicle because they lied about the engine size, the price of the truck and the interest rate was way too high. They said the 3 day or 150 mile money back guarantee was only good regarding the lemon laws. No where on this paper does it say that the vehicle must have something broken and is unrepairable that this guarantee would be in effect. Another lie was that I owed about $500 less on my vehicle that what they said I did!

So after hanging up the phone I drove 30 miles to the dealership from my home. When I got there I talked the manager on duty. I told him I was not please at all, that the truck is only a 4 cylinder. I also showed him the purchase order and the other paperwork that says it is a 6 cylinder. I also showed him the paper on the 3 day guarantee. The person I spoke to said that the person I needed to talk to wasn't there. He told me that I need to come back the next day when he was there. I informed him that if I left that day that I would go over the
150 miles. I informed him of how far away I live and where I work. I work 30 miles away from my house one way. He said there was no problem, don't worry about that.

So I went back again the following day. I spoke to the sales manager Mike. I explained to him my dissatisfaction. I told him about the price raise in my truck. His explanation was they show a different price so it shows a positive equity (lying to the bank, that's fraud)!

I then told him that the truck is only a 4 cylinder and that all the paperwork says its a 6. And I was told this was a 6 cylinder, and that I needed a 6 cylinder for work I need to do. He said that it is just a computer glitch. As long as the VIN
numbers match or the mileage isn't wrong then it doesn't matter. What?!

Since I was getting no where I told him that I wanted to cancel the deal. I wanted their 150mile/3 day guarantee. He said that is only if the vehicle breaks and something to do with the lemon laws.

I asked him about the wrong figures they gave to me on what I owed on my trade, he said he would give me a check, he then just pushed me off to the finance dept. And he disappeared and I left pissed off! So I did not get the check for the difference as he promised. I told the finance department the same things I told the manager and he gave me the same run-around as the manager did.

When I was telling him these things he was typing away at something on his computer. They then sent me to the original salesman (more run-around) who had no idea what was going on.

He thought I was there to refinance the truck. So I told him my problems. He then went to talk to someone. He printed a bogus piece of paper saying all the information on the truck. On that paper it NOW said it was a 4 cylinder! Too bad, it's on my contract as to what they sold me! This obliviously was changed after I had said something. The paper was dated the 16th. My signed papers by myself and the dealer papers saying it was a 6 cylinder, and is dated the 15th. When the salesman came back he had the nerve to try selling me a different vehicle! One with an extended cab and an actual v6. Of course he wanted more money.

He told me my payments would stay the same though because I would get a better interest rate because its a brand new vehicle. What are you talking about, I bought a 2001?!!! What he was not telling me, they were screwing me on my interest rate.

I told my parents who I bought my truck from. My Mom freaked out! She said that if I would have told her where I was buying the vehicle from she would have told me to get out of there as fast as I can. She says that she has friends who also had
problems dealing with the Brown and Brown dealerships. Most of these problems were basically the same where they wanted more money after they had already taken the vehicle. They wanted / demanded a larger down payment. One person she can remember was told after she had left with the vehicle that they wanted another $2,000. Somebody else had a problem with them changing the contract after the deal was done!

This whole experience cost me time, money, inconvenience and a lot of aggravation.

So, I DEMAND THE FOLLOWING:
Besides blatantly changing the price of the vehicle from $14,995 to $21,410, I know they screwed me on my interest rate. So I want a lower interest rate.

For my inconvenience and Brown & Brown fraudulent actions to me and the bank, I want a 6 cyl 2001 with an extra cab, I want my $1,500 check returned and I want my $250 check for the title they tried to charge me for. Even if the title was lost, how much could that cost, 10 or 15 dollars?

I want the best extend warrantee available at the dealers cost as well.

I have been dooped into a total fraud and I want to be compensated accordingly.
