Leased a dirty apartment ripoff

I'm officially filing a complaint because I believe that Marine Creek Apartments didn't have my apartment readily available for occupancy. I called Monday, October 30 regarding my apartment and Sean, the other Leasing Director told me that it wasn't available to view because it wasn't clean. He told me to call back in 10 minutes and he would let me know. I called back and he told me that it would be available to view Tuesday, October 31st.

I went by the very next day and Ethan took me to view the apartment. When Ethan opened the door, the odor was of mildew and cats. I asked Ethan had the apartment been cleaned and he assured me that it had been. I then asked if the carpet had been cleaned and he said yes. Once we got back to the office I was told that in order to move in that day I would have had to pay for October 31st plus November's rent.

I told Ethan that I didn't get paid until Friday, November 3rd so we decided to make Friday my move in date. I called back to see if it was a possible to get new carpet and Julie Lang the Office Manager told me no. I explained to her that it was because the carpet was worn and smelled like mildew and cats. My request was denied. Tuesday November 1st, I was told by the apartment complex where I was living in at the time that I needed to move out or sign a new lease, so I called Ethan back and explained to him that I needed to move and that I opt to accept the one month free special. I went by Wednesday afternoon, November 1 to sign the new lease and keys.

I went into the new apartment Thursday evening and proceeded to shampoo the carpet on my own. It took me eight shampoos to get the carpet in the living area clean.in the bedrooms, they were full of cat hair particularly in the closets. It was so much that my vacuum was full of cat hair. I thought that I had gotten it all so I didn't bother to notify the office.

On Friday, November 3rd, the movers moved in my big items and later when I picked up my daughter, she couldn't stay inside of the apartment because of the cat hair and dander. Her allergies flared up so that she had to go and sit in the car until I finished moving.

I called the office Saturday morning, November 4th and Ethan said that he assured me that the previous tenants didn't have a pet. I told him that just because it wasn't on record doesn't mean that they didn't sneak a cat into the apartment. I also discovered Friday that the dryer wasn't heating, the thermostat was broken, and the ceiling fan in the second bedroom wasn't working properly. I also told Ethan during the walk through Tuesday, October 31st that I found hair inside of the medicine cabinet and he assured me that housekeeping would go back and clean it.

To this day, it is still dirty. The whole apartment is dirty! The floors are dirty, the bathtubs, the countertops, and I'm not sure if the walls were painted because someone killed a bug on the wall in the bedroom and left it.

She also mentioned that every time she or the other staff members went inside that they never saw a pet of any kind. I told Julie that more than likely it's the reason why there were so many items in the apartment that needed repairing because they had a pet inside of the apartment without properly notifying the office to prevent from paying a pet deposit. And if they did come inside of the apartment, they kept the cat in the bedroom closets. That's where most of the cat hair is located.

I wrote Julie a letter requesting along with new carpet that she prorate the rent for the days that my children and I have been unable to stay in our new home. She declined. Julie kept saying that she was sorry that I felt that way but it's clear that she's not apologizing that the apartment wasn't clean and readily available for lease. This means that neither she nor Ethan is taking responsibility for not making sure that this apartment home was ready for lease. She feels like by installing new carpet she's granting the request as a courtesy but actually, making sure that the carpet is in good condition and is clean is Marine Creek's responsibility. And if the request was granted a week ago then I wouldn't have had to stay with my mom a whole week until they installed the new carpet.
