Ripoff dishonest fraudulent billing

I had just moved and needed to set up new high speed internet service. I decided to use Earthlink. I accessed their website and signed up for their DSL service. I was contacted by a sales rep and a DSL kit was to be shipped out, but before it was, they wanted to verify that DSL service was available in my area. After the test, done while I was on the phone with the sales rep, it was determined Earthlink does not offer DSL service in my area. The sales rep was to cancel my order and refund my initial fee, which was done.

Since then, I have been billed every month by Earthlink for a service I do not have and that is not even offered to my service area. I've called almost every month to tell them to cancel my account and refund the amount they charged my credit card. I had to do this for almost six months. Finally, after the fifth or sixth time calling, I thought they actually got the clue and actually cancelled my account. Was I wrong.

Today, almost a year and a half after the initial cancellation of my account and fraudulent and unauthorized charges each month, I was contacted by a collection agency stating Earthlink has put my account into collections for $257. I contacted Earthlink to find out why I was sent to collections when I never received service and their response was they cannot assit me. I also contacted the collection agency and their response was to speak to Earthlink.

I am trying to seek legal action to resolve this situation, but have not found anyone interested in my case. I wonder how many other people this has happened to.
