Has been selling an incomplete software for 10 years and kept promising a final version for these years but never released one

The author of this software has been selling this product known as Pixel32, Pixel Studio Pro and Pixel image editor for 10 years as a beta/release candidate for a "special price" until "the final version gets released" or until "release candidate x gets released". The problem is that he never released any beta or release candidate on time, let alone the final version which was clearly announced to be released in 2006. The next year he changed the date to 2007 and the year after that he announced that it would not be released until April. After this date passed he made no announcement when the software actually will be released. It was actually stated on his website as early as in 2000 that "Final version is expected to be released in March or April. We are working also on BeOS and Linux ports of Pixel32." (http://web.
