The seller was'n sent my items

Hello,

I gave to seller a order what we agreed, i paid him for 5 piece nokia n95 8gb total 1823$ on 7 february used by paypal. On 8 february said he that he sent the items. But the items arrived not to me.

I want open a case by paypal, but they told me " we can make noting, it was more days as 45 days. This situation is in deadline." the seller answer my mails not. What can i do? Can somebody help me about this situation?
