Took payment, never delivered goods, and never credited money back as they committed to in writing

On 10/10, I purchased one twin size Solitude mattress from Mattress King at 7496 South Tamiami Trail, Sarasota, FL. 34231 for $909.49. When I purchased the mattress the store manager said the delivery date was 10/17 to my home at Sarasota, FL. 34238. Before the transaction was completed, I specifically confirmed the delivery date because I informed the manager that I was relocating at the end of the month and it must be delivered at the date specified. I also told him that I would personally pick up the mattress at the store at 7496 S. Tamiami Trail on the delivery date to expedite the delivery. The manager said that 100% it would be delivered on that date.

On 10/17, the Mattress King store did not call as previously committed to inform me that the mattress was available for pick up. I called the store and was told by the same manager that the mattress arrived damaged, and that a new mattress had to be ordered. I explained to him again that the delivery date was crucial because I had movers arriving, and I must have the mattress delivered immediately or else he was going to have to credit my account. Again, the manager told me it would not be a problem and the mattress would arrive by Monday, 10/20/08 and that they would deliver it to my home on the 21st due to the inconvenience. On 10/21, the mattress was not delivered and I contacted the Mattress King store and was told that the manager was not available but (after I gave my receipt #) the employee looked it up and said the mattress did not come in. I explained to the store employee that the delivery had to be made by today, 10/21 because my movers were arriving over the weekend to assess and begin packing for my move. I told him that if it was not delivered that day, that I would be in the store the next day for a refund of my money. He said he would track it down, and call me back he did not.

On Wednesday, 10/22, the mattress that I ordered and paid for had still not been delivered. I personally went back to the Mattress King store and spoke with the same manager who originally sold me the mattress. I handed him the original store receipt, and said that I wanted a refund of my money because as of that date he had still failed to deliver the mattress that I ordered on 10/10, and was to be delivered over a week ago and that the 2nd mattress was to be delivered by end of day yesterday and it was not. I asked him if the mattress was in today, and if not then I wanted a refund of my money because he failed to deliver the mattress that I purchased. He said that he apologized that the first one arrived damaged, and the second mattress was delayed and that he would have my mattress delivered by Friday. I told him that was not an acceptable option because, as I explained from the beginning of the sale on 10/10 I was moving out of state and that is why I had him confirm the delivery date to assure that I could receive the mattress before my movers arrived. He said that he understood, and apologized for the delays. He said that he would send the refund up to the main store, and that they would process it. I asked him when the refund would be processed and he said by the end of that week, at the latest. He wrote on my original receipt cust to get refund. Not working 10/22.

On 10/24, the refund had not been posted to my account. I phoned the Mattress King store and spoke with the same manager again and asked the status of my refund to my credit card. He said that he would make sure it processed that day. On 10/25, the credit to my credit card had not been posted. I contacted Advanta to start the dispute process, informed the dispute specialist of the problem, and faxed in a copy of the original receipt with the store managers note on it, the original purchase date, and the delivery date given.

On 11/17, I contacted the Mattress King store again at 9:55A.M. And spoke with the same manager and asked him where my refund to my credit card is. He took my receipt number, looked up the invoice, and said that hasn't been done yet? I told him it had not been credited back to my card yet and that I was looking at the current statement. He said okay, I'll call down there and have them take care of it today.

To date, I still have not received the refund to my credit card. As well, I have never received the product purchased. This vendor, Mattress King has taken my money and failed to ever deliver the product. At this point, I have completed my move to California and would like this matter resolved immediately.

I have a copy of the original receipt with all of the transaction information, and the credit note written on it by the store manager.
