My husband and I purchased a home to be built by Hannity Homes on October 31 with the assumption that it would be built within 90 days once the slab was put down. The slab was put down on or about January 15. The house was completed by February 28 except for the fact that no one applied for the variances on the well and septic. So here we have a closing set to take place in March but no house. So the closing was cancelled. The variances came through at the end of May. The well and septic were completed in June so I thought we would be ready to close on July 4th weekend. I was told it would take two more weeks. Then again I was told two more week. Then I was two and a half more weeks. The problem is the company will not pay the impact fees that are due of $9,842 to get the CO and we cannot get the CO until the impact fees are paid. The impact fees are to be paid by the builder. Here we are August 14th with a mortgage company that is ready to close and we cannot close without the CO. The mortgage company will only honor our note until August 25th and then we will have to start the process all over again.
In the mean time we have been paying a mortgage of $600, storage for our items of $125 and had to move out of our apartment because we could not pay the rent. We have been paying the mortgage since March, which is an interest only construction loan and does not apply to anything. We also have to pay this month since I just got a call from the Title Company that said they had to cancel the closing today. Hannity Homes still cannot say when we will be able to close. All the appliances are in, the sod is down, the painting is done. Since this process has started, our home has depreciated and I am afraid that if we have to start the process all over again, I will not be able to get this house. There is no excuse why they cannot get the CO. They had the nerve to say that the reason we could not get the CO is because the Building Inspectors are behind three weeks so they did not want to schedule the inspection for three weeks. I called the Building Inspector directly and they said they could have a CO issued within two days three tops. They were very insulted that this builder could say this.
