In may i went to Bill Heard Chevrolet to trade in a truck i had bought 10 month ago the sales man i worked with was Michael Gunn after running my credit app he said make two more payments then come back and we can help you so i did on July 17 me and my mother came in and met with Mr. Gunn he said he still had my app from before we sat down and he added my mothers info on the app as a co signer during that time i told him i had changed jobs and he said he would change that later.
He went to the desk came back said lets pick out your new truck so we did then we went to financing were i wrote out three checks for my down payment two for $1,000 and one for $1500 the two were to be cashed on august 15 the $1500 check was not to be cashed but held until they received my refund from the extended warranty on my trade in that i was to cancel and arrange for them to get the refund they showed my that they paid off my trade for $26.200 and they gave me around $15.500 for my trade in so i owed them about $11,000 they added
that to the purchase price of the truck making me pay taxes on that money a second time?
Well we signed the papers got my new truck that was July 17 they told me it was a finished deal a bank called Nuvell has picked up the loan my payment on my trade in was due on the 18th of July i dint pay it they told me it would be played off before i was out of my grace period so i didn't well about 9 days later my phone rang and it was Nuvell credit they asked me about my employment i gave them all the info and made her aware that i told my salesman and he didnt change to app like he should have she said she would have an answer in a day or to as to what they were going to do the next day bill heard called and said that the financing fell through i told them that id the salesman had done his job that would not have happened they talked to him and he admitted i had told him about my new employment well they got the general manager involved and he said he would take care of it and run it through there bank NCCI
Well it was about that time that my back called me to tell me i was overdrawn by $1600 i got on line and seen that bill heard had run the checks through a week before the agreed upon date i called bill heard and talked to Gary in accounting he said it was there fault and they would take care of all charges involved on the 15th Gary called me and said he was going to run the checks back through i told him only one because i used some of the money to pay the back charges and store charges on the 9 checks that had bounced because of this he said fine well on august 21 my bank who financed my trade in called me saying i was now two payments behind and i needed to catch them up i told them that the truck was to be paid off already they said they had not heard anything from the dealership
So i called and talked to a girl named Teresa in finance she said that the manager still had the file and would call me back the next day she called and told me she had talked to my bank and promised them the payoff by Monday well two days later i got a call from Gary in accounting and he said i needed to bring the truck back that they were not going to finance me i asked why he said the general manager made the decision and i would need to talk to him it took 5 hours of calling 5 times an hour to finally get him on the phone and when i did he told me it was my fault that the checks bounced and i had not met my down payment obligations to them there for there is no deal so now i have no new truck my trade in is behind two months on the payments.
What little credit i had built by paying all my payments on time for a year is down the drain i now have no extended warranty on my truck im out over three hundred ninety dollars in bank and store check charges. I have late fees and penalty s on my trade in payment. Why can they get away with this i cant believe there isnt laws that protect us from dealership fraud and scams like this? To date they have not payed me back for all the bounced check charges they promised to pay
