Ripoff/scam to steal and sell a trade in knowing customer will not be approved for credit

My son thought he was approved for a new truck, gave BHC his dodge truck as trade in and $2000.00 cash. Was instructed by salesman to write a "Hold Check" for $3500.00 which would be returned to him upon his bringing in the $2000.00 cash down payment which along with his trade in allowance of $1500 added up to $3500.00 downpayment reflected on contract. Salesman assured him his "Hold Check" would be returned. This did not happen, when my son took the $2000.00 cash payment and was accompanied by salesman to retrieve the check BHC "could not find it, but would shred it when found".

Sometime later he receives a telephone call from BHC telling him his financing did not go through and he needs to return the new truck. He returns the truck and speakes with finance manager Nolan asking that his Dodge truck be returned. Nolan tells him the dodge has been sold.

My son depends on his truck to make his livelihood. He is a plumber by trade and a vehicle is required.

My son is left with no choice but to drive away once again in the new truck which a few weeks later gets repoed by BHC with all of his tools in truck.

I make a trip to Houston after speaking with Tom Mueller, general sales manager, who states to me during a telephone conservation that all my son needs is a co-signer.

After filling out paperwork with both mine and my husbands SS#'s, my daughter and I are approached by a salesman who tells us that my son "doesen't need a co-signer". Then Mr. Nolan comes up to us and takes us back to his office telling us that he cannot discuss anything until my son arrives and that we should only be taling with him as "the right hand doesn't know what the left hand is doing." Upon my sons arrival, Mr. Nolan tells us that another $2200 is required. A balance of $1500 for downpayment and two monthly payments, all the while assuring us that financing has been obtained.

My son should never have been approved for this purchase. BHC knew this. A credit score of 415 is not very good! Also, BHC wrote over his handwriting "Hold Check" in a different colored pen "Down payment" and tried to cash the check after BHC had assured my son that check had been "shreded". Bank noticed altered check and closed account.

Now BHC has not paid off the Dodge trade in, have sold it, and do not plan to pay it off. The bank is calling my son asking for payment. Now he does not have the new truck and BHC is charging him daily rental and mileage for new truck eating up his downpayment. BHC left my son without a truck. Basically, BHC took his means of transportation to work away.

My son received a letter from the finance company dated the 24th of January, this in one day after my daughter, son, and myself went to BHC. The letter told him they did not approve the financing as requested by BHC but had sent an alternate proposal.
Mr. Nolan was not honest when he told us that financing had been obtained.
