Today I closed on my house. Ameriquest was the mortgage holder they became the mortgage holder after refinancing my home three years ago. According to the Payoff Statement, Ameriquest's payoff on the loan was 139,921.10. Basically, I had to sign the Settlement Statement, otherwise additional late fees would accrue by August 13. However, Ameriquest's Payoff Statement contains several serious errors. The Principal Balance was $133,145.81. There was an additional $5003.86 for Interest at 8.8000%. There was also "Unpaid NSF Charges" of $50, despite the fact that I never had automatic withdrawal with Ameriquest. Another questionable item was a Foreclosure Fee of $1500.
I find this very questionable. Although I had fallen behind in my mortgage payments and had received a Notice of Intent To Foreclose, my house was never in the actual process of foreclosure; so, why was I charged a Foreclosure Fee? It's apparent to me that Ameriquest padded their Payoff Statement with jacked-upped sums "owed" to them. And-after reading articles on this site and elsewhere online-how this company is allowed to continue its unprofessional conduct. Assuming that many of the compliants here are legitimite, then it seems there should be a class lawsuit to shut this company down. As for me, I will be speaking to a lawyer for legal consultation. I also plan on submitting a consumer complaint with the State Attorney General. People need to take action and bring this shameless company to its knees.
