This company has stolen my home from me through illegal practices

I purchased my home in 2005 and my mortgage was sold three times the fourth time it was sold to Select Portfolio Servicing. Prior to having a mortgage with SPS I had no payment problems whatsoever as I pay on time, carry my own Homeowner's insurance policy and pay my property taxes. From day one with SPS I started having problems with late fees when payment was sent well in advance.insurance policy and tax fees were placed on my statement repeatedly even though I had faxed, written and called as did my insurance agent. None of my correspondence was answered.in 2007 I called to make a payment by phone and was told that I was over thirty days late (I was not) and that I would have to sign a Forbearance Agreement or my home would be foreclosed. I paid over 2000.00 and my payment went from 418.00 to 841.00. I continued to make this payment well over the year that I was supposed to be.in that same year while making a payment by phone a CSR informed my that I had gone past my date and my house payment was now 641.18. I then continued to make that payment but continued to be charged late fees, insurance fees, tax fees, etc. At one point when calling to ask why insurance fees were added, once again, a CSR at SPS actually told me that she could see where my insurance company had repeatedly written and faxed my policy information.

In 2008 I was laid off from my job as part of a budget cut. I was drawing unemployement. I received a call from SPS and was told that due to my being unemployed I would have to apply for a modification through the government's program. I told the rep that I was having no problem making my payment and did not wish to participate. I was told that I had no choice as I was "on Unemployment Benefits". I filled out all the paperwork that was sent to me. Some of it was sent multiple times as no matter when or how I mailed it it wasn't received. At that point I asked for a name and physical address and started sending every thing by Certified mail with signature required and a return receipt. I paid what I was told and several times more than I was told. I was not comfortable with any of the government's so called modification and would sent my regular amount. That resulted in my being sent a letter telling me that overpayment might result in my not being approved for modification. I have five file folders full of paperwork, tax returns, inquiries into every aspect of my life that each are the size of a large city phonebook. Even though I had copies of every piece of correspondence and was sending as stated above I would still get more requests for the same documentation. I had even copied their postmarks as all of this had become ridiculous. I found myself spending hours on duplicate forms, spending money on Certified mail or Fed Ex delivery only to be told that it "hasn't been received".in February I received a letter telling me that I did not qualify for the modification "due to not sending all information". The week prior to that I had received a letter stating that I DID qualify. The letter stating I was not eligible had a number to call. I did so and was told that I would have to pay $5,000.00 in "administrative fees" within 30 days or my home would be foreclosed. I asked to simply pay my regular payment and was told I did not qualify for a loan with SPS as I was still on Unemployment.

At the age of 57 I filed Bankruptcy just to save my home. I did not owe anybody else, no credit cards, financed car, I filed simply so that I would not lose my home as I did not have 5000.00 for so called "administrative and "other" fees. SPS did not answer my attorney's request for an itemization for these so called "admistrative and other" fees nor did they send a representative to the Bankruptcy hearing. Therefore I was ordered to make my regular payment, payment to the attorney and the bankruptcy trustee. I had found employment starting in July and had taken a job making much less. I was actually working to pay aforementioned. I had signed in court an agreement to take 390.00 out of my check bi-weekly. Somehow, without my knowledge or my attorney's, SPS went to the Bankruptcy Trustee and put an additional amount and I was sent a letter after the fact. Now I was having 498.00 taken out biweekly. I continued to work for a year. I am a nurse and had contracted hepatitis C in 2001 from a needle stick but had continued work as a medical instructor until being laid off in 2008. The job I took in 2010 was in a pschiatric hospital and involved heavy lifting (of patients). I worked in a building for violent patients and there many nights of having to left patients to carry them into isolation rooms or for restraint.By the end of the year I had been hospitalized twice and had developed back pain that would not stop. I was "laid off" in the last day of June. SPS was being paid both payment and for their additional fees, all of which were illegal to begin with.

As of July I filed for Disability as I now had learned that in addition to my compromised immune system I also have Degenerative Disc Disease and had displaced all of the lumbar vertebrae. I immediately called SPS to make payments directly to them and was told that due to my Bankruptcy status I could not do so. I called the Federal Bankruptcy Court to make payments to them and was told my Bankruptcy status was being dismissed so to call SPS. Neither would accept a payment. I called several agencies that are supposed to "help" and received none.in February my Bankruptcy Resettlement was officially dismissed and the first week of March I had a notice written in marker that my house was in foreclosure. I received a letter from SPS the next week and now my adminstrative fees were 13,000.00 even though I had paid on a so called 5,000 for a year. I called an attorney who check with the county courthouse to try to stop the foreclosure and he was "locked out". I was told to go to the courthouse the day of the auction and I did so. The county clerk could not find anything regarding my property and the following day the attorney could not find anything in any record where my house had been purchased at auction. However, the next week, and this is still going on, I have had young men in private cars, tape notices of eviction, letters offering me money for my keys, etc. None of the correspondence is notarized or from anyone that can be called. Some is written in black marker. My life has become a living hell.

Now I have an attorney working on this and am hoping for the best. Apparently every thing from forcing me into an unwanted modification to the foreclosure notice that was not signed by any legal entity is ILLEGAL. All these unwarranted fees, insurance fees when I am insured, etc. Harrassment by individuals that work for SPS taping grammatically incorrect notices on my door are illegal but as they don't identify themselves and do the taping in the middle of the night I have continued to be harrassed. I purchased my condo in 2005 for 85,000 with a 21,000 downpayment.

Turns out SPS had "repossessed" my home and is sending these goons in hopes I am so desparate that I will take 1000 and vacate. No way. I have owned three homes in my life, have owned a business and I am not an idiot. This company was after my home from the moment they bought or acquired the mortgage. They are getting away with every predatory lending and collection practice one can think of but are still operating. I am now having to go through legal process to get my own property back. I can honestly say it was stolen as it was. I will not vacate the property and plan to fight this company to the very end. I cannot believe that any company can do this to an individual but have learned that there are several and SPS are on the top of the list.
