Misapplied payment, unexplained charges and fees cause forclosure proceedings 3 times in 4 years

November 11 a payment made at Wells Fargo Bank was applied to a loan with the bank. After numerous attempts of having the money applied to the mortgage payment received letter from the bank in January stating that the money will be applied to the mortgage as of the date the bank received it. They admit it was a bank error. January 27 December payment received but applied to the November payment. February 19 January payment made but was $80 short so it was put in a suspense file not applied to mortgage. So according to WFHM we are now over 60 days late. End of February went to make what we thought was the February payment and they refused our payment. February 28 our November payment is finally applied to our December payment. Called their customer service and was told because we are 60 days late cannot accept payment. We were told because the one payment was $80 short it is not applied to the mortgage but to fees they have added to our loan. We tried to work out a repayment plan but were unsuccessful.

We received forclosure papers. June filed chapter 13—to save the house 13 days before the Sheriff Sale.

Tried to make January payment in February was told 30 days late will not accept payment. From the middle of February until the middle of April talked to 5 different people trying to make repayment arrangements. The first person told me it was possible but my lunch time was up (spent talking to them) and told I would call back that evening. When I called back there were other issues (escrow) that had to be taken care of first. Then I was told I had to wait a few days for that info to be updated. Called back 2 days later was told did not qualify for repayment plan. During one of these discussions, I was told by one of their representatives that a payment would be due May 2.

A couple of days later called back to see about a loan modification. I was told all request need to be in writing. During the 2 months talking repayment plan no one mentioned that it needed to be in writing. So we wrote a letter requesting a loan modification, had it delivered certified. Said I would make the required payment May 2. It was received by WFHM 4/21/06. On April 30 I called to see where the payment was to be sent. At this time again I was told by WFHM not to make any payments until a decision is made. Beginning of May received Foreclosure papers again with Sheriff Sale set for 7/18/06.

Received a letter dated May 25 with a repayment plan. We were told we didn't qualify. I requested loan modification with the balance added to my mortgage. They wanted an additional $100 a month added to our already increased payment due June 15, July 15 & Aug 15 with a balloon payment of $6300 due Aug 31 and an increase monthly payment due Sept 1. This was a total of over $10,000 due in 3 1/2 months. If we had this kind of money I don't think we would have fallen behind.

We sent in the June 15 payment along with the signed agreement which they received on June 15. Only to find out that none of the June 15 payment was applied to the mortgage. Was applied to their legal fees.

The Aug 15 payment and balloon payment were not made. It seemed like we were going to be able to refinance but because of the bankruptcy debts were unable to afford it. Now we again face foreclosure Sheriff Sale date of 10/31/06.

I do not believe anyone when they way the mortgage company wants to help you keep you house. We honestly believe they are trying to steal our house.
