In 2000 my mortage was sold to Ocwen and my trouble started in 2002.in March we filed for backruptcy, chapter 13 to keep Ocwen from foreclosing on us.
Our first payment after the bankruptcy to Ocwen was due in May. Ocwen for some reason decided that my first payment was due in April. As a result of this all of my payments for the last 14 months has been one month behind.
That was only the beginning. Ocwen is now trying to get my chapter 13 set aside so that they can foreclose on us. Ocwen has stated that the reason for this action is that we have missed a payment. We have proof that the payment was made and they recieved it. We have been sending out payments signature return. As of August they are still saying that the payment was never made and are still going forward with their motion to set aside the chapter 13 so that they may foreclose on our property.
I would be very intrested in being part of the class action lawsuit against Ocwen that was brought by Mr. Hanson in Ct. If anyone could let me know how to become a part of it I would appreciate it greatly.
