I filed Chapter 13 in 1997 due to lost of income and job history. Anyway the company was IMC mortgage and then Citifinancial and finally Fairbanks (Ironic) name starts with "Fair"!
Anyway they took over the loan and between the companies selling out to other mortgage companies. Fairbanks sent me to the courts 5 times in 1 year. They were thrown out of court the last time and their lawyer fianally gave up and said that he would stop them from going to court by giving me a stay. They had me behind on my payments of almost 2 years. I took the reciepts to the chapter 13 administrators and went to their lawyers offices and gave copies to him..
I finally have a company ready to pay them off and they feel that they have been ripped off. I offered them to pay the balance off of $223,000 with monies left over in the bankruptcy $3400.. They refused and said that they were losing too much monies. They had two realtors to come out and embarrase me to get a appraisal of $213,000 and $220,000 range. Lower than what I owed..
I finally got a company to pay them off and they refuse to give payoff due that they do not wish me to make a penny. This is strange due to the fact that I paid over 40K in out of Bankruptcy and they can't find the monies. Even though their lawyer has the reciepts. Asked today and they will not let the new mortgage company pay them off until the Hud1 is to their satisfaction. Another issue is that I have 2 loans with them and that is the real issue. They did not even know in their own company that I had 2 loans with them after arguing with them for over 2 years..
I am a minority and they have harrased me in court, by not showing up, and when a representative did show up. They had no facts. The judge through them out but it caused me stress on having to take off my job to go to court on and on..
I wish that something could be done about this situation..
It is a terrible thing minorities have to put up with. I thought slavery was over until I had to deal with these people..
