Wells Fargo Home Mortgage
Filled Motion for Relief of Stay! Forecloure!

We filed Chap. 7 and are awaiting discharge. We were 2 months behind in our 2nd mtg. To Wells Fargo (first is with Wells too)... We had a hearing the end of Aug. Because they filed the Motion for Relief from Stay... The judge gave us 4 weeks to catch up those 2 payments which we did. The 2nd hearing was Thursday. Our attorney said that we did not have to go. We just saw on PACER that Wells Fargo was awarded the Motion for Relief from Stay and can now move forward with foreclosure proceedings!
We paid the 2 month that we were in arrears. We did not pay the late fees that were owed because our attorney said that we only needed to pay the 2 months that we were behind and the the late fees would only have to be paid when the mortgage was satisfied.

We would not even be behind those 2 months if Wells Fargo wouldn't have screwed up. Last year we switched banks and called Wells Fargo with the new bank information... Well they somehow still took it out of the old account... Which obviously didn't have any money in it... Then they added 2 months late fees on which I refused to pay since it wasn't our fault that they tried to take the money out of the wrong account! Since then the fees have added up month after month because of that. I have been on the phone with then for countless hours speaking to a different person each time and each one telling me a different thing.

So now here we are... Caught up on our payment and Wells is going to foreclose on our property because we owe them late fees for something that they did! And now we have to pay their attorney fee's for the filing of the Motion for Relief of Stay!

We are a family of 6 and live in the house that is on my grandfather's property along with my parents and sisters whom all live on this same ground... I am sick thinking about how they can do this over such a small amount (approx. $1000 of late fees and Attorney fees).
I don't know how to fix this situation and our lawyer is of no help!: (
