I had a car of mine repossed in 2003 and Calvary Portfolio out of Arizona purchased the debt. SIn the next year I received 1 letter and 2 phone calls, where I stated I would set up a payment plan. They wanted it all paid up front which I wasnt able to do.
Fast forward to January. I havent heard from this company in at least 2-3 years. I have worked hard to build my credit score up over the last 5 years. Its not great but its not awful now. I just recieved a letter from the Civil Process Division forom the state of Massachusetts telling me a warrant has been issused for my arrest.
After calling and speaking to a deputy, I was informed that I was considered in "contempt of court" for not paying on a judgement against me delivered in December. I then found out that Calvary had the summons sent to an old address, therefore I never received it and the won a judgement of $3890.00 against me.
This company has made me look like a bad citizen for failing to show up to court. This is no longer on my credit report and now i owe over $4000 dollars to this company. I have no issues paying a debt I owe, but these shady practices by this company are not right. Every other peice of mail gets to my current address, which I have been at since 2004. Why did Calvary send the summons to my old address? So they could win the judgement? Do I have any recourse?
