On October 2 I deposited $1150 check to the account at Jersey City Wachovia branch. I did it at the teller's window. Approximately two weeks later I realized that on October 2, $1150 was withdraw from the account. As soon as I could I went to a local branch in Bogota. I talked to Mr. Marcos Samaniego (201-678-3800). He said he would investigate the case. I faxed him a copy of the receipt for the deposit. Since then I talked to him and other Wachovia representatives number of times. I also obtained a phone number to Mr. Rudy Atkinson (201-226-2919), Mr. Samaniego "leader", but I wasn't able to contact him. Mr. Samaniego during one of the conversation asked me to contact the person who issue the check and find out name of this person's bank and if the check cleared. On November 6 I was finally able to contact the person that issued the check. She said that the check cleared. On November 7 I called Wachovia and provided them with that information.
Today (November 8) I was advised by Mr. Samaniego, that Wachovia is not going to give me my money back. I asked them for a letter of explanation but Mr. Samaniego refused to give it to me. He said that I may get one in the future, but he wasn't sure when and if.
Mr. Samaniego says that the check was lost after it was deposited, and Wachovia can not track it down.in order for them to continue the investigation I have to obtain a copy of the deposited check. If I do that, they might be able to resolve the issue. At this time they couldn't promise that even if I get them the copy of the check they would give me my money back.
