I need help!
All of our problems started in January when we contacted Gmac about checks that were mailed to them for the months of November & December not being cashed. When we talked with them they told us that the checks we just "lost" maybe by our mailman and that we should just cancel the checks with our bank and submit new checks. During my conversation with them they informed me that in March a payment was never made to them, I stated to them that a payment was made and that our mortgage was sold during the month of March from Countrywide home loans to Gmac. I was told to fax all of cashed checks to the Gmac reserch dept. And they will slove this whole mess. Well that when the real mess began. On January 23 I faxed them all of the information that they requested from the bank. I also mailed a check in the amount of $ 3,876.00 for the payments they "lost". On January 30th I contacted Gmac and asked to talk to someone in their research dept. The customer service rep told me that there is no I could talk this dept. But reassured me that my case was in the research dept and I should be getting a phone call or letter in the mail in about 10 days. I waited until Febuary 13th 2007 I called them again to make sure that the received my check in the amount of $ 3,876.00 which they received and cashed. I asked again at this time to be connected to someone in the Gmac research dept. I was told again that someone in that dept was working on our case and it could take a "couple of weeks".
In March I recieved a notice of foreclosure on my home from Gmac. I made yet another phone call this time to their collection dept. And tryed to explain to them about this whole mess. I was told just to ingore the notice that the records show that there is a open claim in the research dept. When I explained that I wanted to just speak with someone in the research dept I was told again that there is not anybody I could speak with. But I would be contacted by them.
The following months I received nothing from Gmac reseach dept. About this claim but I was still getting foreclsure notices in the mail. At this point I contacted a Laywer. I have always had a high credit score that was being ruined by Gmac. I was paying Gmac every month and they were taking out all kinds of late fees and processing fees out of my monthly Mortgage payment. Leaving me with a credit on my statements that I could not figure out.
In May I got some letters from realtors & lawyers about selling or saving my home. So I called one of them and they informed me that on May 21. Gmac had filed with the courts for foreclosure on my home and this was on public record with our local court house. I was shocked!
I contacted my lawyer about this and he made some phone calls to Gmac lawyers and was told that I can just pay Gmac $ 12,434.00 to slove this whole mess that they created! On May 24th I got my check for the month of May back in the mail rejected by Gmac. Gmac wants their money so bad that they did not even deposit my check. After speaking with my lawyer I then submited two checks to Gmac one for the month of May & one for the Month of June. Well they cashed one check but returned one to me rejected. Go figure.
My lawyer then contacted Gmac again about this and demanded to speak with someone in the research dept about the claim that I had submitted to them 6 months ago. He was told the same story I was told over and over again that somebody was working on it and that we would be contacted by mail very shortly. Well finally on June 2nd 2007 we did receive a letter from the Gmac reserch dept. Asking us to once again submit all the same information that we submitted back in January. Which we did. But at this point they have already filed the foreclosure with the courts We are on a never ending rollcoaster ride with this no good company! They don't want our money just our home! Our so called american dream has turned into out american nightmare!
We need to band together to get a civil suit so we can inform the public of Gmac dirty deeds!
