Our loan ws purchased in a "block" of loans by Ocwen Federal Bank/Collection Agency / Insurance Co. What ever name suit them at the time. We, as the many others on this site were not notified the loan had been sold by our original mortgage co. Nation Mortgage Co in Denver Colorado.
We received numerous phone call demanding that we pay thousands of dollars of back payments to them, Ocwen. I thought it was a scam, our payments went directly to National Mortgage. They would not give me any proof that they bought the loan, so I call National Mortgage and was told by their person that the loans had been sold to various companies and all of the records had gone with the sales. She looked up our account number and said the loan had been sold, but to whom she didn't know. The nightmare begins.
I received more calls from Ocwen demanding that I send the the money and I refused since I still had no account number to which to address the funds, and National already had our money and refused to refund or transfer to the new morgage company.By this time months (4) had gone by, I had stopped the automatic payment to National, but still no written notice. I called the Attorney Generals office for the state of Colorado, and was informed that there was indeed a scam where calls were made and people were so afraid of losing thier homes that they just sent the money. I was advised not to send any money until I had written confirmation that our loan had been sold to Ocwen.
I wrote letters to Ocwen on a daily basis demanding proof that they bought the loan, I also wrote letters to National demanding the same proof. No answer, nobody knows anything either place.
Finally I got confirmation and sent them 2 payments and instructed them to get the others from National and sent them the Bank proof that the withdrawals had been made and sent to National. I made forbearance agreements to keep them from taking my home until the mess was straightened our, I had no idea that they had no intentions of doing anything to make things right.
I never received a statement as to where the payments were credited, only nasty phone calls threatening to take my house and stating that they never got the payments. Finally we had to take a chapter 13 bankruptcy to save our home.
To make a long story short, we tried to re-finance our loan and get out from under Ocwen and we found that the payoff was 29,000.00 dollars mor than we had borrowed and paid on for 5 yrs. I demanded an accounting of what they did with my money and what came was unreadable and so tiny that even a magnifying glass couldn't make out what it said. Our lawyer has gone the rounds with Ocwen and their accountants (are they the same as Enrons?) with no satisfaction.
We did re-finance and are now trying to recover all the thousnads of dollars that Ocwen has stolen from us. Where is our Erin Brocovitch??? Ocwen isn;t poisoning the water we drink, they are rendering families homeless, creditless and depressed beyond imagination.
Is there not a lawyer sho has the guts and morals to take this case on for all of the little working people who can no longer afford to have a roof over their heads let alone hire a lawyer. The public trustee in my county said that he had heard that each and every time Ocwen gets sued they pay off the customers homes and gibve them money to keep their mouths shut. What does that tell you about Ocwen. They are theives, criminals, and robbers of the american dream. I'm game to take them on, but I can't so it alone, there is strength in numbers.
Their game is to divide and put families at eachothers necks, blaming eachother for the wrong that Ocwen has done. Then they have you where they want you broken in spirit, relationships and financially, then they come in for the kill and you are the victim. THe buck should stop here but will it. I want to be a part of a class action suit. Who is brave enough to take them on K. Jones Colorado Springs Colo.
