Ripoff Illegal actions towards ex-employee and have paperwork to prove it!

I am the wife of an ex-Regional Vice President for Aegis Lending Corporation as of 12/07/05. My husand was hired by this company on 5/23/05. We were currently living in Wisconsin and the company relocated our family to Indiana. The company planned for my husband to run three offices in Ohio and develope the opening of offices in Indiana and Illinois.

Before our belongings were unloaded from the truck, my husband's boss, Nelson Daluz, National Sales Manger for Aegis, called and told him that he had resigned his position effective that day, wished my husband good luck his new position.

Things progressed well until 9/05 when five employees were not paid for overtime that was owed to them. One employee did not receive payroll for this month. My husband resolved five out of the six issues with Helene Jones-Wall, Regional HR Manager, via phone.

In 10/05 my husband learned Indiana and Illinois were never planned to be developed by Tim Caryl, National Sales Manager, who replaced Mr. Daluz. At the same time we encountered an issue with the guaranteed sign on bonus that was offered to him upon starting with this company. Basically they shorted us $5,000, 00 of the four month sign on bonus of $10,000.00. There were also more employees that didn't receive payroll in his region. Their explanation for the error was Hurricane Katrina had effected HR in Baton Rouge, LA. Everyone sympothized with the situation and waited patiently for resolution. It was 11/05 when they split the $5,000.00 half in payroll check and half in a manual check overnighted to our residence.

We progressed thru 11/05 if no payroll issues. But my husband's intuition told him something was still not right with this company. He began to explore other employment opportunities.

On 12/7/05 my husband was enroute to Ohio when he was informed of a conference call which included five Regional Vice Presidents with Tim Caryl, National Sales Manager, and Mike Reddington, Executive Vice President. He was informed that due to buget costs the company was eliminating five regions effective immediately. And his offices were to be shut down by 12/31/05 and his position was no longer needed effective that day. He was told he would be paid thru 12/15/05 payroll and all corporate expenses would be paid up to 12/15/05.

We received a overnight letters on 12/08/05 from Helene Wall, Regional HR Manager, stating his employment was terminated for lack of production and he would be paid wages and vacation thru 12/07/05. The second letter stated that he was overpaid by $5,000.00 and they were witholding his paycheck and we owed them $2,216.14 to be paid to them in five days.

This of course was quite a surprise considering this issue dates back to 10/05 that I mentioned earlier. As for the reason of termination hard to believe because he has the numbers to prove he made Aegis 18 million dollars in five months time. No mention of paying his corporate expenses, which currently total $4,101.17. He was informed via letter to contact Zianna Rougeau at payroll if he had any questions, so he did.

Zianna Rougeau then refers him to talk to Helene Wall. He finally made contact with Mrs. Wall on 12/13/05, who stated she would investigate the overpayment. On 12/16/05 Mrs. Wall called my husband ans stated the error was found in compensation department and he did not owe $5,000.00 and final paycheck along with corporate expenses would be paid 12/30/05.

On 12/30/05 nothing was received from Aegis. My husband called Mrs. Wall on 1/02/06 and she refers him to call Katie Buchanan, Payroll Manager for Aegis. She was contacted immediately after speaking with Mrs. Wall. She informed him she had no prior knowledge of this issue and contact Mrs. Wall to gather the information, and would contact him.

On 1/02/06 we received a letter from Illinois Department of Family Services stating we owed $5,270.73 in back chid support and a lein was placed on our property for this amount. We then contacted the agency who imformed us that Aegis had only been paying half of the court ordered monthly child support since 7/05.

On 1/03/06 Katie Buchanan called my husband and stated that she was cutting a manual check and would overnight it for $3,061.49 which was payroll and another check corporate expenses would be included, but did not mention dollar amount. My husband informed her the amount of corporate expense and the problem that had developed with child support. She denied any knowledge of that problem.

On 1/03/06 we received legal advice that Aegis had denied the court order child support payment which is known as contempt of court and would be responsible for payment.

On 1/06/06 we received the overnight manual checks, one for the above amount and one for $98.94, the corporate expense they had found. Once again the amount of corporate expenses is $4,101.17.

Of course, we deposited these checks on 1/07/06 into checking account. On 1/12/06 these checks were returned to our back as Not Sufficient Funds, which inturn caused our account to overdraw. We will seek legal advice on this as well.

Welcome to my nightmare. Just wanted to know if anyone else has encountered such financial problems while being employed with Aegis Lending Corporation. I figure there has been and considering this company increased the unemployment rate in Ohio by 25. This number does not include the other 4 regions and 109 from Headquarters that were let go. My heart goes out to all the families.
