My husband and I bought two phones from Total Communication in Anderson, SC on April 27 because I was expecting our baby at any time, and we wanted to be able to reach one another if anything happened. We paid full price for the phones which I assumed meant that they belonged to us. Signed up with Cingular on a two year contract with a fifteen day cancellation policy meaning that if we weren't happy with our service, within fifteen days of purchasing the phones we could cancel our service with no penalties and just pay for minutes used. So on May 11 after having service that never worked anywhere and only one phone call that actually went through and had a good connection, we called Cingular to disconnect our service on May 11 04. That was 14 days after we bought the phones if I can count right.

So we were under the assumption that our service was turned off and we returned the phones to Total Communications to get a refund on the purchase of the phones and was told by Laura that it would be mailed to us, well after about a month which was June 14 and no refund I called Total Communications and was told that the phones were damaged and could not get a refund so I told her that I would be there tp pick them up cause we paid full price for them. I got there and argued with her about the damages cause the phones still had the plastic over the faceplate and were in perfect condition. Since that day the phones have been in my backseat floorboard in the boxes that they came in, no service and dead batteries. Well low and behold after all the uproar with Total Communications. Cingular sends us a bill for $968.54. Saying that the phones were used June, July & August and we called in May and spoke to Candy and was told our service was cancelled, and we even called the phones to see and got the recording that this was not a working number. So now here we are calling Cingular and getting bounced from one person to next who doesn't know what to do so they send us to someone else who is supposed to know what to do and we still have yet been able to talk to anyone who has any sense there, faxed over documentation to them that proved paying for the phones and contracts spoke with Laura at Total Comm who verified that the phones were behind her desk for a month and were never used and also the date that we turned them in to her which was 5/11 and asked her to call them and she says okay and obviously didn't or isn't good enough we are being charged for damamges to the phones which we own!

Liquidation Fee's of $220 per phone for breaking our contract which we did within the 15 day grace period and are now being threatened that they are going to turn this over to collections. We have excellent credit never late on bills but this is one bill that we refuse to pay because it's a ripoff to be charged $900 for awful service that never was worth having and one call and 14 days of having service. We are going to our attorney with this and hope to get a lawsuit against Cingular, because this is not right to be done this way and we refuse to have our credit ruined over this ignorance that Cingular has.
