water, sewer & garbage bill dispute
Between 2004 to City of Hydaburg has been billing my address for Water, Sewer & Garbage service tht did not exist and also the water was tainted with contamination as unsafe to consume.
City of Hydaburg continued to billing dispite a complaint has been addressed many times with the city office that the garbage service was NEVER picked-up.
They continue to warn the public and consumer that the BOIL YOUR WATER NOTICE IN EFFECT has been noted for a long time requiring customers to boil the water for safe consumption, however the water find its way to caused direct illness to me.
In November I contacted the new PUBLIC WORK FOREMAN to please picked up my garbage and he obliged, the garbage service finally commenced and I then forward the monthly payment with a certified letter stating to the city clerk to use this US postal money order with memo addressed to pay bill from December to current month service, also I also stated in that letter by accepting the payment they are instructed to pay ONLY the current account from the date of December to curent. I then later received teh receipt from the city office stated they received
I later received a receipt from that payment in the mail.
However, the city clerk several months later says in their letter that they then decided to apply the previous payment to the oldest bill dating back to 2004 billing and they state they are not obligated to comply from my previous request and agreements in thta certified letter I addressed earlier with the first payment.
I continued making monthly payment via uS money orders with a dated memo to pay current invoice on the check to pay for the month to month billing.
City clerk recently sent a letter saying that I need to pay the remaining balance of the $2,400.00 bill before they issue a disconnect orders thereafter.
I sent a certified letter that I acknowledged their intent and I advised them the I fully intend to file a litigation lawsuit for damages if they shut off my water service to my home.
A sidenote: it is still Winter and the tempature is 25 degees freezing.
I came home from work Thursday February 24 and found a 48 hours disconnect order on my door of my home that I have to pay up the remaining balance or my water will be disconnected on Monday Febraury 24.
My point is I do not owe this about of the bill and they been billing me for the water and garbage service that did not exist and selling unsafe drinking water. But they contineud to ignore my complaints to the city office.
I have requested a information of their city ordinace vias a cetified letter and it took three months before they responded back to me without a copy of the their city ordinance, thus denying me my rights to examine the city ordinance.
The city clerk never offer any information to file a grievance with the city office disputing the bill.
But she is very adamantly that she wants to have this bill paid one way or the other.
She states she fully intend to fiel a small clais against me if I don't pay this bill.
I refused to pay a bill that was never picked up to selling me a unsafe water to drink.
