I worked for the custom wireless booth at the burlington mall for approximately two weeks as a salesman. During the hiring process I had to fill out every paper twice because they lost them the first time. On my first day of work I forgot to bring in the proper identification. They let me work anyways under the agreement that I would bring them in the next day. So needless to say I was not clocked in for that day.
During the two weeks that I was there I did not make many sales, but the sales that I did make, I noticed that there was no way for me to know how much I was supposed to earn. According to the computer at the store I had made 70 dollars in comission.
I clocked in every day that I worked except one day that the computers were down. I clocked in as soon as they were back up. I specifically asked the manager, Dan Burk, to change the time to when I first arrived. He did not.
I worked for two weeks, scheduled for 46 hours per week. Tuesday through saturday 12-8, sunday 12-6.
When I quit after two weeks I recieved a check for $360. When I asked Dan about the rest of my pay he avoided telling me for sure if I would get it or not. He said IF you have another check, it should be here in about two weeks.
When I came back for my check he told me that I was not getting one. He told me that the check I got covered my comission, and that this was a comission based position. I reminded him of the fact that he himself told me on multiple occasions that for the first two weeks I would be on hourly pay of minimum wage ($8 per hour) plus 10% comission. I also reminded him that I have clocked in every day and have been the only one in the booth doing so.
He then looked shocked and said did you clock in?
He made a call to someone and said a few things. One of those things I remember being "yeah he clocked in...".
When he got of the phone he told me that I would have to call the office number and speak to who he was just on the phone with. I believe the financial director, whos name I had to convince Dan to tell me, and when he did I couldn't understand. He told me that everyone calls him 'K'.
I called the number multiple times and no one ever picked up. I called the store back and a salesman I worked with named Jamaine answered. I asked to speak with Dan and he asked who was calling. When I told him it was me he told me to stop calling because I wasn't getting my money and I should stop trying. He then hung up the phone.
About five minutes later I called back and asked in a slightly differant voice for 'the manager' instead of 'Dan'. Jamaine said that the manager had just left and that he was the assistant manager so he could help me. I said no and hung up.
I stopped by the mall a few times hoping to catch Dan there. On the 3rd or 4th try he was there. He told me that I could come back on the next payday which was the 10th of June and get my check. As I walked away Jamaine said something along the lines of 'YEAH YOU'LL GET YOUR SEVEN DOLLARS SOON!' and laughed. I ignored him believing that he was just being a jerk.
I returned on the 10th to find out that the office had supposedly mailed my check to me. It is now the 25th an I still have not recieved my check.
